Dought & clear, - Her husband divorced her (talaaq) then took her back, then she asked him for a second and third talaaq, and is asking whether this is khul‘ or talaaq

:-> My husband said once „I divorce you”. Then he took me back but after some time i found out he did something really bad that he knew would hurt me very much so i told him to divorce me. The same day he said „Talaq” but he says he felt his heart breaking by this (he didnt want a divorce but agreed top do it because i wanted). The next morning i called him and aked for 3rd divorce so he said „talaq” again. I didn't give him back my mahr as i didn't know about such thing as khula at that time. Now i'm confused – are we divorced by talaq, by khula or not at all? Please answer me as soon as possible. Praise be to Allah Firstly: It is not permissible for the wife to ask for a divorce (talaaq) from her husband without a valid shar‘i reason, because the Prophet (blessings and peace of Allah be upon him) said: “Any woman who asks her husband for a divorce when it is not absolutely necessary, the fragrance of Paradise will be forbidden to her.” Narrated by Imam Ahmad, 21874; and Ibn Maajah, 2055. What is meant by the phrase “when it is not absolutely necessary” is without there being any hardship which makes it necessary to resort to talaaq (as-Sindi’s commentary on Ibn Maajah). Secondly: What has happened is that your husband divorced you with the first talaaq, then took you back; then he divorced you once again, based on your request. Then you asked him for another talaaq after that, so he gave you another talaaq. In this case only two talaaqs have definitely taken place, namely the first and second talaaq. The second talaaq cannot be ruled out because of what your husband said about not wanting it to count as such, and that he only spoke the words to go along with your wishes, because if the husband utters the word of talaaq, knowing what it means and not being forced to say it, then the talaaq counts as such whether the husband really intended it or not. This has been discussed previously in fatwa no. 171398. With regard to the third talaaq, if your husband had not taken you back after the second talaaq, then there is a difference of scholarly opinion as to whether the third divorce counts as such. Some of the scholars said that it does count as such and others said that it does not. The more correct view is that it does not count as such, as we have previously explained in fatwa no. 126549. But if your husband had taken your back following the second talaaq, then he issued a third talaaq to you, then it does count as such according to scholarly consensus. Thirdly: With regard to your question about what happened and whether it is a talaaq or khul‘, the answer is that it is a talaaq because it took place with the word of talaaq and without any compensation (from the wife). In fatwa no. 126444we have previously explained that in the case of khul‘ there must be compensation. Any separation between husband and wife that happens in return for compensation is khul‘, even if it is done by uttering the word of talaaq, according to the correct scholarly opinion. Dought & clear, - If consensus has been reached, it is not permissible for anyone differ from it

:-> Does the ijtihaad of modern scholars override the consensus of the Sahaabah? Praise be to Allah If consensus has been reached, it becomes binding shar‘i proof, and what is required is to follow it; it is not permissible to differ from it. Imam ash-Shaafa‘i (may Allah have mercy on him) said: The command of the Messenger of Allah (blessings and peace of Allah be upon him) to adhere to the main body of the Muslims is one of the proofs that the consensus of the Muslims – in sha Allah – is binding. End quote. Ar-Risaalah, p. 403 As-Sarkhasi (may Allah have mercy on him) said: Consensus is definitive proof in the same way as texts (of Qur’an and Sunnah). Just as it is not permissible to overlook a shar‘i text because of some view that is contrary to these texts, it is also not permissible to go against consensus because of a different view that came along after consensus was formed on the basis of sound evidence. End quote. Usool as-Sarkhasi, 1/308 Shaykh Muhammad ibn ‘Uthaymeen (may Allah have mercy on him) said, in the commentary on his bookal-Usool min ‘Ilm al-Usool(p. 498): If the Sahaabah were all agreed on any issue, then their consensus disallows any differing view from being valid. Hence it is not permissible for anyone who comes after them to differ from their consensus, because consensus disallows any different views, as it constitutes binding proof. End quote. Going against consensus may reach the level of kufr, if consensus was definitely reached and there is no doubt concerning it. Shaykh al-Islam Ibn Taymiyah (may Allah have mercy on him) said: Everything on which they are agreed must have been based on a text from the Messenger. Every issue on which there was definitely consensus, and there are no different views among the believers, is guidance from Allah, and going against such consensus constitutes kufr, just as it is kufr to go against a clear text. However, if it is thought that there was consensus, but it is not definite, then in this case we cannot be certain that this is guidance on the basis of the teachings of the Messenger. The one who differs from consensus in such cases is not regarded as a kaafir; rather the idea that there was consensus may be mistaken, and the correct view may be something other than that. This is the decisive answer concerning who may or may not become a kaafir by differing from consensus. End quote. Majmoo‘ al-Fataawa, 7/39 Thus it is clear that once it is proven that there was consensus, it becomes binding shar‘i proof, binding upon all Muslims, and it is not permissible for anyone to differ from it on the basis of “making ijtihaad” or any other claim. For children, - Charity Stories: Joy of Charity

:-> One famous scholar, Sheikh Muhammed Hadi Al Amini relates that his father while acquiring knowledge in Najaf, Iraq, went to his home town Tabriz. While he was in his home town, he used to visit his relatives and friends. Sheikh Amini's father didn't see an old acquaintance of his who was a poor and needy man. When he didn't see this friend, he asked about him and was told by people, that the man he was asking about was a rich man and no longer poor. Sheikh Amini's father decided to pay a visit to his friend. While conversing with his friend he asked his friend the reason for the change in his economic position. The man replied that he had been very poor to the extent that he was forced to sell some properties that belonged to him, like furniture etc. By selling these things he had collected some money enough to start a business with. As he was on his way back to his house with the capital, he saw a poor lady crying. The man asked the lady the reason for crying, and she explained that she was a widow with orphans who were hungry. The man felt pity on her, and on seeing that she needed the money more than himself he gave the whole amount of money to her. He returned home and spent the night depressed and worried for his family. The next morning, surprisingly he was summoned to the house of a rich man. When he went to the rich man he was told by the rich man that he had six thousand bags of rice which he feared were on the verge of expiring. The rich man suggested to him to buy the rice at a low price on loan from him. The poor man did so and sold the rice bags quickly. He took some more and in this way was able to make much profit. Soon he became rich and well to do. Indeed Noble Qur'an says that: "Who is it that will offer of Allah a goodly gift, so He will multiply it to him manifold, and Allah straitens and amplifies, and you shall be returned to Him." (2:245)
