*- WHAT ISLAM SAYS -* - Islam is a religion of Mercy, Peace and Blessing. Its teachings emphasize kind hear tedness, help, sympathy, forgiveness, sacrifice, love and care.Qur’an, the Shari’ah and the life of our beloved Prophet (SAW) mirrors this attribute, and it should be reflected in the conduct of a Momin.Islam appreciates those who are kind to their fellow being, and dislikes them who are hard hearted, curt, and hypocrite.Recall that historical moment, when Prophet (SAW) entered Makkah as a conqueror. There was before him a multitude of surrendered enemies, former oppressors and persecutors, who had evicted the Muslims from their homes, deprived them of their belongings, humiliated and intimidated Prophet (SAW) hatched schemes for his murder and tortured and killed his companions. But Prophet (SAW) displayed his usual magnanimity, generosity, and kind heartedness by forgiving all of them and declaring general amnesty...Subhanallah. May Allah help us tailor our life according to the teachings of Islam. (Aameen)./-

Islamic Articles, - Examples of women's rights Islam – I

Islam is the true liberator of women. It has preserved the rights of a woman from the time she is a mere fetus in her mother's womb till the time she is laid down in her grave. Even after that:
1- If a woman is divorced during pregnancy, the father is obligated to support the mother while she is pregnant.
2- Islam protected the rights of a woman by not allowing a woman to be punished or incarcerated for a crime while she is pregnant as to not harm the baby. "When the woman from the Ghaamidi tribe came to Prophet Muhammad sallallaahu alayhi wa sallam and said: Purify me. He sallallaahu alayhi wa sallam told her:"Wait till you deliver your baby."
3- Islam protected the rights of a woman when she is a baby being nursed. When that Ghaamidi woman delivered the baby and asked for her punishment, the Prophet sallallaahu alayhi wa sallam said:"Go and nurse your child till the child is capable of eating solid food."]Muslim[
4- Islam protected the rights of a woman as an infant by obligating the father to provide for food and clothing.
5- Islam protected the rights of a woman as a growing upchild by obligating the father to provide for her based on the general evidence related to the obligation of providing for children.
6- Islam protected the rights of a woman in matters of inheritance regardless of her age.
7- Islam protected the rights of a woman in choosing a suitable husband. She has the sole right to accept or refuse a proposal of marriage if she has been previously married. The Prophet has said: "A previously married woman cannot be married until she approves."
8- Islam protected the rights of a virgin woman. She cannot be married without her consent. The Prophet sallallaahu alayhi wa sallam said:"A virgin shall not be married until she is consulted."]Al-Bukhaari[
9- Islam protected the right of a woman to a dowry when she is wed by obligating the husband to provide it.
10- Islam protected the right of a woman to demand a divorce in exchange for something she gives to the husband if she no longer wishes to remain with him out of fear that she may not fulfill his rights )or for any other Islamically acceptable justification(.The Prophet sallallaahu alayhi wa sallam said to a man whose wife had demanded a divorce she could not reach the state of loving him:"Accept the garden )the dowry as compensation( and divorce her."]Al-Bukhaari[
11- Islam protected the rights of a woman when she is divorced.
12- Islam protected the rights of a woman when she is widowed, by allotting her a portion of the inheritance.
13- Islam protected the rights of a woman when she is divorced before consummating the marriage by not obligating her to wait for 'Iddah )the prescribed period before she can remarry(.
14- Islam protected the rights of a woman when she is an orphan by allotting her a portion of the spoils of war, an allowance from the treasury, permitting her to take charity, and encouraging people to help her.
15- Islam protected the rights of a woman in her social life and in her relationship with kith and kin by prohibiting her husband from marrying her sister or aunt.
16- Islam protected the rights of a woman regarding her self-respect by prohibiting men from lustfully looking at her.
17- Islam protected the rights of a woman by punishing anyone who accuses her of adultery without sufficient evidence.
18- Islam protected the rights of a woman if she is a mother by obligating her children to honor and respect her and prohibiting them from speaking back to her disrespectfully.
19- Islam protected the rights of a woman when she is breastfeeding her child by obligating the father to compensate her if she wants it.
20- Islam protected the rights of a woman when she is pregnant.
21- Islam protected the rights of a woman by obligating her husband to provide her housing.
22- Islam protected the rights of a woman by exempting her from fasting when she is pregnant or nursing.
23- Islam protects the woman's rights to choose to return to her husband who divorced her once or twice after the end of her prescribed waiting period with a new marriage contract. Islam prohibits preventing her from doing so if there is an agreement between the two parties. Allaah Almighty Says )what means(:“… Do not prevent them )women( from remarrying their ]former[ husbands, if they mutually agree on equitable terms”.]Quran 2:232[
24- Islam protects the woman's rights to have custody over her children unless she remarries. The Prophet sallallaahu alayhi wa sallam said to a divorced woman asking for keeping her child under her custody:“You have more right over him unless you ]re[ marry”.]Ahmad and others[
25- Islam protects the woman's rights during her menses by forbidding sexual intercourse with her, due to the harm it causes her and guarding against her feeling of repulsion. Allaah Says )what means(:“…Keep away from wives during menstruation…”]Quran 2:222[
26- Islam protects the woman's rights during her menses by allowing the act of loving-making, fondling and foreplay without the actual intercourse. This is a proof that the aim is not to avoid contact with women in this period; rather to avoid intercourse due to the harm it causes.
27-Islam protects the woman's rights to dignity and honor during her menses. There are examples in the way the Prophet sallallaahu alayhi wa sallam to treat his wives during this period to support this. 'Aa'ishah may Allaah be pleased with her narrated: “We )she and the Prophet sallallaahu alayhi wa sallam( used to drink from the same cup; he would put his mouth on the same spot I drank from and would finish my drink when I was in menses”. She also narrated: “While in menses, I used to comb the hair of Allaah's Apostle sallallaahu alayhi wa sallam.” And: “The Prophet sallallaahu alayhi wa sallam used to lean on my lap and recite the Quran while I was in menses.” And: “We would sleep together in one cloth while I was in menses”.
28- Islam protects the woman's rights by prohibiting having anal intercourse with her, as this is considered unjust and wasteful of her rights.
29- Islam protects the woman's rights against incriminating her of committing acts of fornication without the testimony of four witnesses. Allaah Says in the Quran )what means(:“Those who commit immorality ]i.e. unlawful sexual intercourse[ of your women – bring against them four witnesses from among you...”]Quran 4:15[
30- Islam protects the woman's rights by forbidding killing women in wartime, even if they were atheists. The Prophet sallallaahu alayhi wa sallam forbade the killing of women and children during wartime.
31- Islam protected the rights of a woman by granting her the right to a will.
32- Islam protected the rights of a woman even after death, and this is for men and women, for, in Islam, harming or abusing the dead is like abusing the living. An evidence for this is the Hadeeth )Prophet's saying(:"Breaking a dead person's bone is like breaking his /her bone while alive."]Abu Daawood[
33- Islam protected the rights of a woman )as well as a man( when she is in her grave. The Prophet sallallaahu alayhi wa sallam said:"It is better for you to sit on burning ambers and your clothes are burned till your skin rather than sitting on a grave".]Muslim[

Dought & clear, - Ruling on aborting a deformed fetus.

If a fetus is found to have some defects (at about 4.5 months of pregrancy), one which includes anencephaly:no brain, and the doctors strongly suggest an abortion since the longest an anencephalic born baby survived was 21 days and since most of such pregnancies end up in miscarriages at a later and riskier stage of pregnancies, or still born baby. what is a muslim couple to do? especially since consulting two knowledgeable islamic scholars each came up with a different solution ie one suggesting abortion the other one suggesting continuing with pregnancy. The couple had to make a decision the soonest possible. what do the laws of islam say?
Praise be to Allaah.
If the fetus has reached the age of four months, then the soul has already been breathed into it, so deliberately aborting it would be regarded as killing a soul - which is a very grave major sin. The doctors' opinion that it is malformed is no excuse at all. If it is miscarried or stillborn, or it is born alive and dies shortly thereafter, the parents will be rewarded for bearing the calamity of their loss, and if it lives and has some kind of disability, they will be rewarded for their patience in taking care of it. Everything that happens to the believer is good for him, but wilfully destroying a soul is nothing but evil and sin. We must also take into consideration the errors that may occur in doctors' reports, and that fact that the condition of the fetus may change and improve.
And Allaah knows best.

Dought & clear, - Will the zaani (fornicator) who repents be forgiven even if the hadd punishment is not carried out on him?.

I would like to know if a person commits fornication and he truely repents towards Allah would he be forgiven in the hereafter if the hadd of hundred lashes is not carried out on him in this world. Can only repentance expiate him from this sin or unless and untill the hadd is not carried out on him he can never be forgiven and will be punished in the hereafter. Please answer in accordance with Quran and sunnah.I will be very grateful.
Praise be to Allaah.
The carrying out of the hadd punishment for a sin for which that punishment has been prescribed is an expiation for that sin.
Sincere repentance from sin is also an expiation for sin, and “the one who repents from sin is like the one who did not sin.” And Allaah will turn his bad deeds into good deeds.
If he is sincere in his repentance, and prays a great deal for forgiveness, then he does not have to confess so that the hadd punishment may be carried out on him. Rather repentance is sufficient, in sha Allaah.
Allaah says (interpretation of the meaning):
“And those who invoke not any other ilaah (god) along with Allaah, nor kill such person as Allaah has forbidden, except for just cause, nor commit illegal sexual intercourse ___ and whoever does this shall receive the punishment.
The torment will be doubled to him on the Day of Resurrection, and he will abide therein in disgrace;
Except those who repent and believe (in Islamic Monotheism), and do righteous deeds; for those, Allaah will change their sins into good deeds, and Allaah is Oft-Forgiving, Most Merciful.
And whosoever repents and does righteous good deeds; then verily, he repents towards Allaah with true repentance”
[al-Furqaan 25:68-71]
It was narrated from ‘Ubaadah ibn al-Saamit (may Allaah be pleased with him) that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “Give me your oath of allegiance and your pledge that you will not associate anything in worship with Allaah, or steal, or commit adultery, or kill your children, or utter slander, intentionally forging falsehood (i.e. by making illegal children belonging to their husbands) [cf. al-Mumtahanah 60:12], or disobey with regard to anything that is good. Whoever among you fulfils this pledge, Allaah will reward him, and whoever does any of these things and is punished in this world, that will be an expiation for him. Whoever does any of these things and Allaah conceals it for him, then it is up to Allaah: if He wills He will forgive him and if He wills He will punish him.”
Narrated by al-Bukhaari, 18; Muslim, 1709.
InSaheeh Muslim(1695) it says that when Maa’iz came to the Prophet (peace and blessings of Allaah be upon him) and confessed that he had committed zina and said, “Purify me (i.e., carry out the hadd punishment on me)”, he said to him, “Woe to you, go back and ask Allaah for forgiveness and repent to Him.”
Al- Nawawi said:
This hadeeth indicates that the burden of sin is lifted from one who repents from major sins, and this is according to the consensus of the Muslims.
Al-Haafiz Ibn Hajar said:
From this case – i.e. the case of Maa’iz when he confessed zina – it may be understood that it is mustahabb for the one whose case is similar to repent to Allaah and to conceal himself and not mention his sin to anyone… This was affirmed by al-Shaafa’i who said: I prefer for the one who has committed a sin and been concealed by Allaah to conceal it himself and to repent.
Fath al-Baari, 12/124, 125
And it was narrated from ‘Abd-Allaah ibn ‘Umar (may Allaah be pleased with him) that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “Avoid these sins that Allaah has forbidden, but whoever does any of them, let him conceal himself with the concealment of Allaah and repent to Allaah, for whoever tells us of what he has done, we will carry out (the punishment prescribed in) the Book of Allaah on him.”
It was also narrated by al-Haakim inal-Mustadrak ‘ala al-Saheehayn(4/425) and by al-Bayhaqi (8/330); classed as saheeh by al-Albaani in Saheeh al-Jaami’, 149.
