Saheeh (sound) hadeeths, Dought & Clear, - * The authenticity of the hadeeth about fighting the Jews

Is the hadeeth saheeh which says that there will come a day when the
Muslims will be victorious over the Jews, so that a rock beneath which
a Jew is hiding will call out, "There is a Jew underneath me, come and
kill him"?
Praise be to Allaah.
It was narrated that Ibn 'Umar (may Allaah be pleased with him) said:
"I heard the Messenger of Allaah (peace and blessings of Allaah be
upon him) say, 'The Jews will fight you and you will prevail over
them, then a rock will say, "O Muslim, here is a Jew behind me, (come
and) kill him."'" (Narrated by al-Bukhaari, no. 3593).
It was also narrated from Ibn 'Umar (may Allaah be pleased with him)
that the Messenger of Allaah (peace and blessings of Allaah be upon
him) said. "The Jews will fight you and you will prevail over them
until a rock will say, "O Muslim, here is a Jew behind me, (come and)
kill him."'" (narrated by Ahmad and al-Tirmidhi, who said, this is a
saheeh hasan hadeeth).
And it was narrated that Ibn 'Umar (may Allaah be pleased with him)
said: "I heard the Messenger of Allaah (peace and blessings of Allaah
be upon him) say: 'The Dajjaal will come down to this pond at
Marriqanaat (a valley near Madeenah), and most of those who go out to
follow him will be women, such that a man will go back to his wife,
mother, daughter, sister or (paternal) aunt and will tie them up lest
they go out to join him. Then Allaah will grant the Muslims victory
over him, and they will kill him and his party, until a Jew will hide
beneath a tree or a rock, and the tree or rock will say, 'Here a Jew
beneath me, (come and) kill him.'" (Narrated by Ahmad in hisMusnad).
This was also narrated by Ibn Maajah from Abu Umaamah al-Baahili from
the Prophet (peace and blessings of Allaah be upon him) concerning the
Dajjaal.
And Allaah is the Source of strength. May Allaah bless our Prophet
Muhammad and his family and companions, and grant them peace.

Saheeh (sound) hadeeths, Dought & Clear, - * Soundness of the hadeeth, “Whoever recites Aayat al-Kursiy after every prayer

What do you say about the hadeeth of Abu Umaamah, that the Prophet
(peace and blessings of Allaah be upon him) said: "Whoever recites
Aayat al-Kursiy after every prescribed prayer is not prevented from
entering Paradise by anything except death"?
Praise be to Allaah.
This hadeeth was narrated by al-Nasaa'i in'Aml al-Yawm wa'l-Laylah, by
Ibn al-'Sunni in'Aml al-Yawm wa'l-Laylah, by al-Tabaraani
inal-Kabeerand by others, via Muhammad ibn Humayr from Muhammad ibn
Ziyaad al-Alhaani from Abu Umaamah (may Allaah be pleased with him)
from the Prophet (peace and blessings of Allaah be upon him). There is
nothing wrong with its isnaad, and it was classed as saheeh by Ibn
Hibbaan inKitaab al-Salaahand by al-Mundhiri, Ibn 'Abd al-Haadi and
Ibn Katheer.
It was extreme on the part of Ibn al-Jaawzi to include it in his
bookal-Mawdoo'aat("fabricated reports"), and this is not to be
accepted.
The hadeeth was narrated only by Muhammad ibn Humayr from al-Alhaani.
This hadeeth may be classified as ma'lool (defective), especially as
al-Qasawi (may Allaah have mercy on him) said: Muhammad ibn Humayr is
not qawiy (strong).
Ibn al-Ma'een disagreed with him and said that he [Muhammad ibn
Humayr] was thiqah (trustworthy). Imaam Ahmad said, I do not know
anything but good about him. Al-Nasaa'i said: there is nothing wrong
with him.
The isnaad of this hadeeth is jayyid, but it is not saheeh. But
reports of this kind may be accepted for a number of reasons:
1. Imaam al-Nasaa'i (may Allaah have mercy on him) narrated it and
did not regard it is ma'lool (defective); he narrated it in
hisMukhtaarahand classed it as saheeh.
2. The hadeeth does not deal with any major ruling of sharee'ah.
3. If asadooq(truthful narrator) is the only one to narrate a
hadeeth, it may be accepted if there is evidence that his narration
was of good quality. The fact that Muhammad ibn Humayr was the only
one to narrate it is a case in point, but there is corroborating
evidence in the ahaadeeth of al-Mugheerah ibn Shu'bah, Abu Mas'ood and
'Ali ibn Abi Taalib, even though none of those reports are saheeh. And
Allaah knows best.

Da'eef (weak) hadeeths, Dought & clear, - * Hadith about the conquest of India

There is a hadith that speaks about the conquest of India and says
that whoever participates in this conquest will enter Paradise. I
would like to know how sound this hadith is, and the reference, the
chain of narrators and the commentary on it in detail. May Allah
reward you with good.
Praise be to Allah.
Firstly:
The hadiths that speak of the conquest of India are as follows:

It was narrated that Thawbaan, the freed slave of the Messenger of
Allah (blessings and peace of Allah be upon him), said: The Messenger
of Allah (blessings and peace of Allah be upon him) said: "There are
two groups of my ummah whom Allah will protect from the Fire: a group
who will conquer India, and a group who will be with 'Eesaa ibn Maryam
(peace be upon him)."
Narrated by an-Nasaa'i (no. 3175) and Imam Ahmad inal-Musnad(37/81),
Mu'sasat ar-Risaalah edn. Classed as hasan by the commentators
onal-Musnad. Classed as saheeh by al-Albaani inas-Silsilah
as-Saheehah(no. 1934)

It was narrated that Abu Hurayrah (may Allah be pleased with him)
said: The Messenger of Allah (blessings and peace of Allah be upon
him) promised us that we would conquer India, so if I am martyred I
will be among the best of the martyrs, and if I return then I am Abu
Hurayrah the freed (protected from Hellfire).
This hadith was narrated via three isnaads from Abu Hurayrah.
The first isnaad is from Jibr ibn 'Ubaydah, from Abu Hurayrah
It was narrated by Imam Ahmad inal-Musnad(12/28) and others. This is a
da'eef (weak) isnaad because of Jibr ibn 'Ubaydah. No one narrated
from him except one narrator whose name was Sayyaar ibn al-Hakam, and
no one regarded him as thiqah (trustworthy). Rather he was mentioned
only in passing by Ibn Hibbaan inath-Thiqaat. Hence Imam adh-Dhahabi
said: It is not known who he was, and the report is odd. End quote.

The second isnaad is al-Bara' ibn 'Abdullah al-Ghanawi, from al-Hasan
al-Basri, from Abu Hurayrah, who said:
My close friend, the truthful one, the Messenger of Allah (blessings
and peace of Allah be upon him) told me: "Among this ummah there will
be an expedition to Sindh and India." If I live to see it and am
martyred, all well and good, and if I – and he said some word –
return, I am Abu Hurayrah the freed, I will be ransomed from the Fire.
Narrated by an-Nasaa'i inas-Sunan(no. 3173) and by Ahmad
inal-Musnad(14/419). But it is also a da'eef isnaad, because of
al-Bara' ibn 'Abdullah al-Ghanawi concerning whom the critics were
unanimously agreed that his hadith is layyin (a kind of weak hadith),
as it says inTahdheeb at-Tahdheeb(1/427). Moreover, there is an
interruption in the isnaad between al-Hasan al-Basri and Abu Hurayrah
(may Allah be pleased with him).
The third isnaad is Haashim ibn Sa'eed, from Kinaanah ibn Nabeeh, from
Abu Hurayrah.
This was narrated by Ibn Abi 'Aasim inal-Jihaad(no. 247), but it is
also a da'eef isnaad because of Haashim ibn Sa'eed, concerning whom
Ibn Ma'een said: He is nothing. Abu Haatim said: His hadith is da'eef.

The fourth isnaad is from Safwaan ibn 'Amr, from one of his shaykhs,
from Abu Hurayrah (may Allah be pleased with him), who said: The
Messenger of Allah (blessings and peace of Allah be upon him) said –
and he mentioned India – then he said: "An army of yours will invade
India and Allah will grant its conquest to them, until they bring
their kings in chains, and Allah will forgive them their sins. Then
they will return and when they return, they will find the son of
Maryam in ash-Shaam (Syria)." Abu Hurayrah said: If I live to see that
campaign, I will sell everything I possess and join the campaign. Then
if Allah grants us victory and we return, then I will be Abu Hurayrah
the freed (protected from Hellfire). And when we return to Syria we
will find there 'Eesa ibn Maryam. Then I shall make sure that I draw
close to him and tell him that I accompanied you, O Messenger of
Allah. The Messenger of Allah (blessings and peace of Allah be upon
him) smiled and said: "Unlikely, unlikely." [very difficult?]
Narrated by Na'eem ibn Hammaad inal-Fitan(p. 409). Its isnaad includes
a narrator who was ambiguous about his narration from Abu Hurayrah.
Its isnaad also includes Baqiyyah ibn al-Waleed who is mudallis and
narrated by saying 'an ("from").

The third hadith is:
"Some people of my ummah will invade India and Allah will enable them
to conquer it, until they bring the kings of India in chains, and
Allah will forgive them their sins. Then they will return to ash-Shaam
(Syria) and they will find 'Eesa ibn Maryam in Syria."
Narrated by Na'eem ibn Hammaad inal-Fitan(p. 399). He said: al-Waleed
told us, from Safwaan ibn 'Amr, from someone who told him, from the
Prophet (blessings and peace of Allah be upon him).
This isnaad is obviously da'eef, because al-Waleed ibn Muslim narrated
it by saying 'an ("from"). It also appears to be mursal, because there
is no indication that the one who told Safwaan ibn 'Amr heard it from
the Prophet (blessings and peace of Allah be upon him) or that he was
a Sahaabi.
So to sum up: the hadith of Thawbaan is the one that is saheeh
concerning the conquest of India. As for the hadith of Abu Hurayrah,
most of its isnaads are da'eef (weak). And Allah knows best.
Secondly:
What appears to be the case from the apparent meaning of the hadith of
Thawbaan and the hadith of Abu Hurayrah – if it is saheeh – is that
the conquest of India referred to will occur at the end of time, and
at a time close to the descent of 'Eesa ibn Maryam (peace be upon
him), not at a time that was close to the era of Mu'aawiyah ibn Abi
Sufyaan (may Allah be pleased with him).
Al-Haafiz Ibn Katheer (may Allah be pleased with him) said:
The Muslims invaded India at the time of Mu'aawiyah, in 44 AH, and
there occurred things which will be explained below. It was also
invaded by the great ruler Mahmoud ibn Sabuktagin, the ruler of
Ghaznah who conquered India around 400 AH. He invaded the land, where
he killed, took prisoners, and captured booty. He entered Somnath
where he broke the greatest idol that they used to worship, and he
captured its swords and necklaces. Then he returned, safe and
victorious. End quote.
Al-Bidaayah wa'n-Nihaayah(6/223)
Hence al-'Allaamah Hammood at-Tuwaijri (may Allah have mercy on him) said:
What is mentioned in the hadith of Abu Hurayrah (may Allah have mercy
on him), which was narrated by Na'eem ibn Hammaad, about the conquest
of India has not happened up till now, but it will happen when 'Eesaa
ibn Maryam (peace be upon him) descends, if the hadith that says that
is saheeh. And Allah knows best. End quote.

Please advise us about the level of authenticity about the hadith
narrated in Majma' az-Zawaa'id wa Manba' al-Fawaa'id from Jaabir,
according to which he said concerning the soorah (interpretation of
the meaning):
"When comes the Help of Allah (to you, O Muhammad (Peace be upon him)
against your enemies) and the conquest (of Makkah),
And you see that the people enter Allah's religion (Islam) in crowds,
So glorify the Praises of your Lord, and ask for His Forgiveness.
Verily, He is the One Who accepts the repentance and forgives"
[an-Nasr 110:1-3]:
[Jaabir said:] When this soorah was revealed to Muhammad (blessings
and peace of Allah be upon him), he said: "O Jibreel, you have
heralded the death of my soul." Jibreel (peace be upon him) said: "And
indeed the Hereafter is better for you than the present (life of this
world). And verily, your Lord will give you (all i.e. good) so that
you shall be well-pleased" [ad-Duha 93:4-5]. The Messenger of Allah
(blessings and peace of Allah be upon him) instructed Bilaal to call
out "As-salaatu jaami'ah (prayer is about to begin)," and the
Muhaajiroon and Ansaar gathered, then the Prophet (blessings and peace
of Allah be upon him) led them in prayer, then he ascended the minbar
and praised and extolled Allah, may He be glorified and exalted, then
he delivered a speech that caused their hearts to tremble and their
eyes to weep. Then he said: "O people, what kind of Prophet have I
been to you?" They said: May Allah reward you with good, O Prophet;
you have been to us like a compassionate father and like a sincere and
caring brother. You have conveyed the messages of Allah, may He be
glorified and exalted; you have conveyed His revelation to us and
called to the path of your Lord with wisdom and beautiful preaching.
May Allah reward you on our behalf with the best reward that He has
ever given to any Prophet on behalf of his nation…. And he quoted the
hadith at length.

This lengthy hadith was narrated by Imam at-Tabaraani inal-Mu'jam
al-Kabeer(3/58), and was quoted from him by Abu Nu'aym inHilyat
al-Awliya'(4/74) and via him by Ibn al-Jawzi inal-Mawdoo'aat(1/295).
He said: Muhammad ibn Ahmad ibn al-Bara' narrated to us: 'Abd
al-Mun'im ibn Idrees ibn Sinaan narrated to us, from his father, from
Wahb ibn Munabbih, from Jaabir ibn 'Abdullah and 'Abdullah ibn 'Abbaas
(may Allah be pleased with them).
Al-Haythami said, after quoting this hadith (8/605):
This was narrated by at-Tabaraani. Its isnaad includes 'Abd al-Mun'im
ibn Idrees, who was a liar and a fabricator. End quote.
Ibn al-Jawzi said inal-Mawdoo'aat(1/301):
This is a fabricated hadith that cannot be sound. May Allah punish the
one who fabricated it and may He curse those who undermine religion
with such nonsense and words which are not befitting for the Messenger
(blessings and peace of Allah be upon him) or for the Sahaabah.
The one who is accused of fabricating it is 'Abd al-Mun'im ibn Idrees.
Ahmad ibn Hanbal said: He used to tell lies against Wahb. Yahya said:
He is an evil liar. Ibn al-Madeeni and Abu Dawood said: He is not
trustworthy. Ibn Hibbaan said: It is not permissible to quote what he
narrates as evidence. Ad-Daaraqutni said: He and his father are to be
rejected. End quote.
Something similar was stated concerning him by as-Suyooti in
al-La'aali in his book on fabricated hadiths entitledal-La'aali
al-Masnoo'ah(1/257), by Ibn 'Iraaq inTanzeeh as-Sharee'ah(1/330) and
by ash-Shawkaani inal-Fawaa'id al-Majmoo'ah(324).
This fabricated hadith contains a number of problematic matters:

It speaks of the story of the death of the Prophet (blessings and
peace of Allah be upon him) and the Angel of death asking permission
to enter upon him, and it mentions unproven details about this major
incident. It is well-known to the scholars that the story of the death
of the Prophet (blessings and peace of Allah be upon him) is one of
the topics concerning which the most lies were told by the liars and
people transmitted to one another many things concerning it that are
not proven.
Al-Haafiz Ibn Katheer (may Allah have mercy on him) said inal-Bidaayah
wa'n-Nihaayah(5/256):
Al-Waaqidi and others quoted many reports concerning the Prophet's
death that contain very strange and weird things, but we rejected most
of them because of the weakness of their isnaads and the oddness of
their texts, especially those that were narrated by many later
storytellers and others. Many of them are certainly fabricated, and
the saheeh and hasan hadiths that are narrated in the well-known books
are sufficient and we have no need for fabricated reports of which the
isnaads are not known. And Allah knows best. End quote.
There is no saheeh hadith or report which suggests that the Angel of
death sought permission to enter upon the Prophet (blessings and peace
of Allah be upon him) to take his soul. All the reports that have been
narrated concerning that are either munkar (odd) or mawdoo'
(fabricated). Please see the answer to question no. 71400.

With regard to the story of 'Ukaashah seeking retaliation from the
Messenger of Allah (blessings and peace of Allah be upon him), a
similar story was narrated via a saheeh isnaad, but in it, it states
that the one who sought retaliation was Usayd ibn Hudayr (may Allah be
pleased with him). 'Abd ar-Rahmaan ibn Abi Layla narrated that Usayd
ibn Hudayr said:
Whilst he – i.e., Usayd ibn Hudayr – was talking to the people and
joking to make them laugh, the Prophet (blessings and peace of Allah
be upon him) poked him in the ribs with a stick. He said: Let me
retaliate. He said: Retaliate. He said: You are wearing a shirt but I
am not wearing a shirt. The Prophet (blessings and peace of Allah be
upon him) lifted his shirt and he embraced him and kissed his side. He
said: This is all I wanted, O Messenger of Allah.
Narrated by Abu Dawood (5224) and via him by al-Bayhaqi inas-Sunan
al-Kubra(7/102). Also narrated by at-Tabaraani inal-Mu'jam
al-Kabeer(1/205); al-Haakim inal-Mustadrak(3/327) and Ibn 'Asaakir
inTareekh Dimashq(9/76).
The isnaad of this hadith is saheeh. It was classed as saheeh by
al-Haakim and likewise by adh-Dhahabi. It was also classed as saheeh
by al-Albaani inSaheeh Abi Dawood.
It says in'Awn al-Ma'bood(14/90):
"the Prophet (blessings and peace of Allah be upon him) poked him in
the ribs with a stick" i.e., he struck him by way of joking and
playing. "He" i.e., Usayd "said: Let me retaliate" i.e., allow me to
poke you in the ribs as you poked me in the ribs. "Retaliate"i.e.,
take your revenge.
"and kissed his side" – the Arabic word translated as "side" refers to
the area on the side of the body between the lowest rib and the hip.
"He said: This is all I wanted" that is, all I wanted by saying let
me retaliate was to kiss you, and I did not really want to retaliate.
End quote.

The hadith also contains a number of reprehensible and odd things,
such as the following:
"The first one who will offer the funeral prayer for me is the Lord,
may He be glorified and exalted, from above His Throne" – does Allah
offer the funeral prayer for anyone?! This is a reprehensible lie of
the fabricators.
"When the soul reached the knees, the Messenger of Allah (blessings
and peace of Allah be upon him) said: 'Ouch!' When the soul reached
the navel, the Prophet (blessings and peace of Allah be upon him)
cried out: 'How stressful it is!' When the soul reached the chest, the
Prophet (blessings and peace of Allah be upon him) cried out: 'O
Jibreel! How difficult are the throes of death!'"
The problem here is that this gives the impression that the Prophet
(blessings and peace of Allah be upon him) was displeased and panicked
at the time of death, but he is far above such a thing.
"We said takbeer following the takbeer of Jibreel (peace be upon him),
and we offered the funeral prayer for the Messenger of Allah
(blessings and peace of Allah be upon him), led by Jibreel (peace be
upon him) in prayer"
it is not known that the angels ever led the Muslims in prayer; rather
this is one of the odd things that were narrated by the suspect
narrators.

Should a man who has more than one wife to consider his menstruating wife or who has post-natal bleeding when he divides his time among his wives?.
Praise be to Allaah.
The basic principle is that it is obligatory to divide his time between both, based on the principle of justice between co-wives.
But the custom in many countries is that when a woman gives birth, she stays with her mother for forty days or less, so that her mother can look after her, or her mother may come and look after her in her own house. In either case, he is not obliged to allocate some time to her, and she may agree to waive her right to a share of his time.
Shaykh ‘Abd al-Rahmaan ibn Naasir al-Sa’di (may Allaah have mercy on him) was asked: Is it obligatory to allocate a share of time to a wife who is menstruating or in nifaas?
He replied:
The well known view in our madhhab (the madhhab of Imam Ahmad) is that he must allocate a share of time to each of them, because they are both wives. But the correct view which should be applied is that the menstruating wife has a right to a share of his time, but in the case of one who is in nifaas, she does not have a right to a share of his time according to custom and because the woman in this situation usually agrees to give up that right; in fact in most cases whilst a woman is still in nifaas she does not want a share of her husband’s time and this is a view in our madhhab. End quote.
Fataawa al-Mar’ah al-Muslimah(2/693).

I am 24 years old and I got married a year ago. My marriage lasted only 6 months, after which my wife’s family accused me of being mentally ill. I proved that this was not the case with the help of a government psychiatrist. This is happening to me because my wife’s family is accusing me and she is agreeing with them, may Allaah forgive her. What should I do? Should I take another wife? Please note that the problem with my wife has been referred to the court and divorce proceedings are under way. If I get married [to a second wife] now, will there be any sin on me?.

Proof that a person is in good mental health and treats others well does not require the testimony of a doctor. What matters is what people see of a man, not the papers he produces.
Hence if the accusations of your wife’s family are based on things that they have seen you do or words that they have heard you speak, then they may have a reason. You have to sort yourself out and mend your ways so that there will be nothing for others to judge you by.
If what they said about you has no real basis, rather it is false and sinful testimony, then we think that you should advise them and explain to them that their false accusation against you is sinful, and tell them how that has caused division between you and your wife. If they recant, then all well and good, otherwise you should shun them, and not let them visit you or let your wife visit them, lest they turn her against you.
With regard to your intention of taking a second wife, what we advise you is to wait and to examine the real motive for that, because often in such cases the decision is based on the desire for revenge against the first wife and her family because of the trouble they caused, and usually when a man marries with this attitude it leads to trouble for the second wife too, if the husband has not set things straight with his first wife and her family.
If you have not set things straight between you and your wife and her family, we think that if you want to take a second wife, you should let the first wife go and divorce her, or you can keep the first wife if you intend to keep both wives if Allaah guides her (the first wife). We also advise you to have a good intention and try to do the right thing, for Allaah says concerning spouses between whom there are difficulties (interpretation of the meaning):
“if they both wish for peace, Allaah will cause their reconciliation. Indeed Allaah is Ever All‑Knower, Well‑Acquainted with all things”
[al-Nisa’ 4:35]
We advise you to fear Allaah with regard to every step you take and not to let this problem cause you to treat her unjustly or to keep reminding her of mistakes that she made but that she has apologized for.
We ask Allaah to set your affairs straight and to make it easy for both of you to do the right thing. And Allaah is the Source of strength.

My question is about a hadeeth – “Whatever Allaah has permitted in His Book is halaal, whatever He has forbidden is haraam, and whatever He was silent about is pardoned, so accept the pardon of Allaah, for Allaah was not forgetful. Then he recited this verse: ‘and your Lord is never forgetful’ [Maryam 19:64].” This hadeeth was classed as saheeh by Shaykh al-Albaani (may Allaah have mercy on him) in al-Silsilah al-Saheehah (5/325), and classed as hasan on p. 14 of Ghaayat al-Maraam.
But according to the website al-Durar al-Sunniyyah many things were said about this hadeeth, such as: its isnaad is very weak (da’eef jiddan) although its meaning is sound; its isnaad is good; its isnaad is saheeh; it is saheeh mawqoof and may be regarded as hasan because of corroborating marfoo’ reports; its isnaad includes Sayf ibn Haroon al-Barjami who was classed as da’eef by a number of scholars, but Abu Na’eem classed him as thiqah (trustworthy); it is da’eef.
Shaykh Abu Ishaaq al-Huwayni said in his website that it is da’eef (weak). What is your opinion about this hadeeth? Is it valid for us to quote it as evidence?
Should we ignore the ahaadeeth concerning which the scholars’ opinions differed?.

Firstly: This hadeeth was narrated in similar versions from a number of the Sahaabah (may Allaah be pleased with them), as follows:
1 – It was narrated from Abu’l-Darda’ (may Allaah be pleased with him) in a marfoo’ report: “Whatever Allaah has permitted in His Book is halaal, whatever He has forbidden is haraam, and whatever He was silent about is pardoned, so accept the pardon of Allaah, for Allaah was not forgetful. Then he recited this verse:‘and your Lord is never forgetful’ [Maryam 19:64].”
Narrated by al-Daaraqutni in hisSunan(2/137); al-Haakim inal-Mustadrak(2/406 and 10/12); al-Tabaraani inMusnad al-Shaamiyeen(3/209) through a number of isnaads from ‘Aasim ibn Raja’ ibn Haywah from his father from Abu’l-Darda’ from the Prophet (peace and blessings of Allaah be upon him).
This isnaad is munqati’ (interrupted), as there is a clear gap between Raja’ ibn Haywah and Abu’l-Darda’, as Raja’ died in 112 AH and Abu’l-Darda’ died in 32 AH.
Ibn Hajar said in his biography of Raja’ ibn Haywah inTahdheeb al-Tahdheeb(3/229): His reports from Abu’l-Darda’ are mursal. End quote.
Al-Dhahabi (may Allaah have mercy on him) said concerning this hadeeth: Its isnaad is munqati’. End quote.
Al-Muhadhdhab fi Ikhtisaar al-Sunan al-Kubraby al-Bayhaqi (8/3975).
Al-Mu’allimi (may Allaah have mercy on him) said likewise inal-Anwaaral-Kaashifah(301).
2 – It was narrated from Salmaan al-Faarisi in the words: “The Messenger of Allaah (peace and blessings of Allaah be upon him) was asked about ghee, cheese and wild donkeys. He said: ‘The halaal is that which Allaah has permitted in His Book and the haraam is that which Allaah has forbidden in His Book, and whatever He was silent about is pardoned.’”
Narrated by al-Tirmidhi (1726); Ibn Maajah (3367); al-Haakim inal-Mustadrak(4/129); and from him by al-Bayhaqi inal-Kubra(9/320 and 10/12). It was narrated by al-Tabaraani inal-Kabeer(6/250) via Sayf ibn Haroon al-Barjami from Sulaymaan al-Taymi from Abu ‘Uthmaan from Salmaan.
Al-Mazzi said inTahdheeb al-Kamaal(8/255): Its isnaad includes Sayf ibn Haroon. Ibn Ma’een said: That is not the case. Al-Nasaa’i said: He is da’eef (weak). Al-Daaraqutni said: He is da’eef matrook (weak, rejected). End quote.
Al-Tirmidhi said: This is a ghareeb hadeeth which we do not know in any marfoo’ report except via this isnaad. Sufyaan and others narrated these words from Sulaymaan al-Taymi from Abu ‘Uthmaan from Salmaan. It is as if the mawqoof hadeeth is more sound. I asked al-Bukhaari about this hadeeth and he said: I do not think it is known. Sufyaan narrated from Sulaymaan al-Taymi from Abu ‘Uthmaan from Salmaan in a mawqoof report. Al-Bukhaari said: Sayf ibn Haroon is muqaarib al-hadeeth. End quote.
Ibn Abi Haatim said in‘Ilal al-Hadeeth(2/10):
My father said: This is a mistake. It was narrated by trustworthy narrators from al-Taymi from Abu ‘Uthmaan from the Prophet (peace and blessings of Allaah be upon him) in a mursal report which does not include Sulaymaan, and this is what is correct. End quote.
Ahmad said: It is munkar, and it was also classed as munkar by Ibn Ma’een.
This was quoted by Ibn Rajab inJaami’ al-‘Uloom wa’l-Hukam(2/69).
Shaykh al-Albaani said inal-Ta’leeqaat al-Radiyyah(3/54):
Its isnaad is very weak (da’eef jiddan), but its meaning is sound. End quote.
3 – It was narrated from Abu Tha’labah al-Khushani (may Allaah be pleased with him) that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “Allaah has enjoined obligations so do not neglect them, and He has set limits so do not transgress them, and He has declared some things forbidden so do not violate them, and He has remained silent about some things out of mercy to you, not because He forgot, so do not ask about them.”
Narrated by a number of scholars, all via Dawood ibn Abi Hind from Mak-hool from Abu Tha’labah.
They differed concerning Dawood ibn Abi Hind.
Hafs ibn Ghiyaath narrated it in a mawqoof report as noted by al-Bayhaqi (10/12); Yazeed ibn Haroon agreed with him as was mentioned by al-Daaraqutni inal-‘Ilal(6/324).
It was also narrated by ‘Ali ibn Mas-har in a marfoo’ report as recorded by al-Bayhaqi inal-Kubra(10/12); and by Ishaaq al-Azraq as noted by al-Daaraqutni (4/184); and by Muhammad ibn Fudayl as noted by al-Daaraqutni inal-‘Ilal(6/324).
Ibn Rajab said inJaami’ al-‘Uloom wa’l-Hakam(2/68):
It has two faults:
1 – There is no proof that Mak-hool heard from Abu Tha’labah, This was stated by Abu Shahr al-Dimashqi, Abu Na’eem al-Haafiz and others.
2 – There is a difference of opinion concerning his marfoo’ and mawqoof reports from Abu Tha’labah. Some of them narrated it from Mak-hool from his words, but al-Daaraqutni said inal-‘Ilal(6/324): What is more likely to be correct is that they are marfoo’. He said: And this is more well known. End quote.
Ibn Hajar said: Its men are thiqaat (trustworthy) but it is munqati’ (interrupted). End quote.Al-Mataalib al-‘Aaliyah(3/271).
Al-Dhahabi said: Munqati’ (interrupted).Al-Muhadhdhab(8/3976).
Al-Albaani said: There is some interruption in its isnaad. End quote.Tahqeeq Riyadh al-Saaliheen(1841).
Conclusion: The isnaads of this hadeeth are not free of weakness, but can it be regarded as strong when they are taken all together?
Some of the scholars were of this view. Al-Nawawi classed as hasan the hadeeth of Abu Tha’labah, as it says inal-Adhkaar(505). It was classed as saheeh by Ibn al-Qayyim inI’laam al-Muwaqqi’een(1/221) and by Ibn Katheer in hisTafseer(1/405). Al-Albaani said inTahqeeq al-Eemaan li Ibn Taymiyah(43): It is hasan because of corroborating reports.
Al-Albaani classed as hasan the hadeeth of Salmaan al-Faarisi inSaheeh al-Tirmidhi(1726). Inal-Mishkaat(4156) it says: It is saheeh mawqoof, but it may be classed as hasan because of marfoo’ corroborating reports.
But others are of the view that the severe weakness in the isnaads of this hadeeth means that it cannot be regarded as strong when all its isnaads are taken together. The hadeeth of Abu’l-Darda’ is plainly munqati’ (interrupted), the hadeeth of Salmaan al-Faarisi is munkar and it is a mistake to regard it as marfoo’ (attributable to the Prophet (peace and blessings of Allaah be upon him)), and the hadeeth of Abu Tha’labah is munqati’ and there is some dispute as to whether it is marfoo’.
This report from Ibn ‘Abbaas (may Allaah be pleased with him) is saheeh, but it is his words (not the Prophet’s). This was narrated by Abu Dawood (2800).
Ibn Katheer said inIrshaad al-Faqeeh(1/367): its isnaad is saheeh.
It was classed as saheeh by al-Albaani inSaheeh Abi DawoodandMishkaat al-Masaabeeh(4074).
The general meaning of the hadeeth is also established in the basic principles of Islam, and is quoted and accepted by the scholars.
Ibn al-‘Arabi said in‘Aaridat al-Ahwadhi(4/185): The meaning of this hadeeth is proven inal-Saheeh. End quote.
Abu Bakr ibn al-Sam’aani said: This hadeeth is one of the basic principles of Islam. It was narrated from some of them that he said: There is no single hadeeth of the Messenger of Allaah (peace and blessings of Allaah be upon him) which sums up all the basic principles of Islam apart from the hadeeth of Abu Tha’labah. End quote.
Jaami’ al-‘Uloom wa’l-Hikam(2/70).

Secondly:
It should be noted that when the scholars rule that a specific hadeeth is sound or weak, that may refer to a specific isnaad, and does not refer to the hadeeth with all its isnaads. For example, a scholar may judge one of the isnaads to be weak, then elsewhere he may judge another isnaad of the same hadeeth to be sound. This is not a contradiction, rather it is based on a difference in the isnaads in question. This is what happened in the case of Shaykh al-Albaani when he spoke about the hadeeth under discussion here; he classed it as saheeh when reported from Abu’l-Darda’, and he classed its isnaad as da’eef in the reports of Salmaan al-Faarisi, but he classed it as hasan because of corroborating reports, so it is hasan li ghayrihi in his view. That is not a contradiction; rather it is in accordance with the principles of the science of hadeeth.
The Muslim has to follow the truth as it appears to him after researching and striving to find out what is correct (ijtihaad). If he is not able to engage in ijtihaad, then it is sufficient for him to follow well known scholars whose knowledge he trusts and who are trustworthy, and he should not pay any attention to anyone else. This includes matters of hadeeth and fiqh.
