Sifat al-Hajj wa’l-‘Umrah (Description of Hajj and ‘Umrah), Doubt & clear, - * Not staying overnight in Mina during the days of Tashreeq









I hope that you can explain the ruling on not staying overnight in Mina during the Days of Tashreeq. If the answer is that (the one who does not stay in Mina) is obliged to offer a sacrifice, then should he offer a sheep for each night or is one sufficient?

Praise be to Allaah.
Staying overnight in Mina during the Days of Tashreeq is obligatory according to the majority of fuqahaa’; the one who fails to do that with no excuse is obliged to offer a sacrifice. According to the majority of scholars one should stay there for most of the night.
(al-Mawsoo’ah al-Fiqhiyyah, part 17, p. 58).
Not staying overnight in Mina during the Days of Tashreeq may be one of the following cases:
The first case: when a person does not stay overnight in Mina because he has an excuse.
Shaykh Ibn Baaz was asked about the ruling on a person who does not stay overnight in Mina during the Days of Tashreeq. He said: “He is not obliged to offer any sacrifice because Allaah says (interpretation of the meaning):‘So keep your duty to Allaah and fear Him as much as you can’ [al-Taghaabun 64:16]– whether he did not stay overnight at Mina because of sickness or because there was no room, of for some similar legitimate excuse such as those who bring water to the pilgrims and those who tend sheep, and whatever else comes under the same rulings.
The second case: when a person does not stay overnight (in Mina) during the days of Tahsreeq with no excuse.
The Shaykh (may Allaah have mercy on him) said:
Whoever does not stay overnight in Mina during the Days of Tashreeq with no excuse has failed to do something which was prescribed by the Messenger of Allaah SAWS (peace and blessings of Allaah be upon him) in both word and deed, and by the fact that he made a concession for some of those who have excuses such as shepherds and those who bring water to the pilgrims. Concessions can only be made when there is something which has to be done. Hence staying overnight in Mina during the Days of Tashreeq is considered to be one of the obligatory duties of Hajj, according to the more correct of the two scholarly views, and whoever does not do that and has no legitimate excuse has to offer a sacrifice, because it was reported that Ibn ‘Abbaas (may Allaah be pleased with them both) said: “Whoever fails to do one of the rituals [of Hajj] or forgets it, let him offer a sacrifice.” It is sufficient to offer one sacrifice for not staying overnight in Mina during the days of Tashreeq.”

He should offer the sacrifice and share out its meat among the poor in the Haram, and he should not eat any of it. And Allaah knows best.

My question is about hastening to leave during Hajj. Why does the one who hastens leave depart on the twelfth (of Dhu’l-Hijjah) and the one who stays departs on the thirteenth, when Allaah says “Whoever hastens to leave in two days” [al-Baqarah 2:203]? Wouldn’t that mean that the one who hastens would leave on the eleventh?.

Praise be to Allaah.
The meaning of the verse is one who hastens to leave within two days of the days of al-Tashreeq, which are the eleventh, twelfth and thirteenth. So hastening to leave means leaving on the twelfth. Perhaps the questioner assumed that that first day was the day of Eid, but this is incorrect.
Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) said:
I would like to alert our brother pilgrims to this mistake, because many pilgrims assume that what is meant by the verse“Whoever hastens to leave in two days” [al-Baqarah 2:203 – interpretation of the meaning]is leaving on the eleventh, so they count the two days as the day of Eid and the eleventh of Dhu’l-Hijjah. But this is not the case, rather this is a misunderstanding, because Allaah says (interpretation of the meaning):
“And remember Allaah during the appointed Days. But whosoever hastens to leave in two days, there is no sin on him”
[al-Baqarah 2:203]
The appointed days are the days of al-Tashreeq, and the first of the days of al-Tashreeq is the eleventh. Based on this, the phrase “whoever hastens to leave in two days” means in two days of the days of al-Tashreeq, which is the twelfth. So people should make sure that they understand this matter correctly, so that they will not make mistakes.

Engagment, Doubt & clear, – * Seeing a number of women for the purpose of marriage










I would like to know if we are allow to see many women for the purpose of marriage or do we have to see them one by one I mean if it's not OK with the first one only I can go to see the second one.

Praise be to Allaah.
Looking at the woman to whom one wants to propose marriage has only been made permissible because of necessity, to be certain and put one’s mind at rest, and in order to follow the Sunnah, as mentioned in the hadeeth of al-Mugheerah and others. But four necessary conditions apply:
The first is that one should be serious about marriage; the second is that the man and woman should not be alone; the third is that there should be no fear of fitnah (temptation); and the fourth is that it should not go beyond the limits set by sharee’ah, i.e., looking at what usually appears, which is what she shows to her father, brother and other mahrams. See Question #2572. On this basis, a man should not look at any woman except the one whom he seriously wants to marry. If he is pleased with her, (he should proceed with marriage), otherwise he should move on to another. And Allaah knows best.
