About Jumma in Al Quran

Fathwa, - Defects that affect marriage, - His marriage proposal was rejected because he has vitiligo

Question
i am a moslem man 31 years old i have vitiligo )white patch on the skin not contagious but probably inherited( my spot is on the lips a few small dots, 2 years ago its not visible but now its a little bit visible and thers a few man saw this in the mosque and they began telling everybody about this and know i am embarassed to go to the mosque, except on friday, what is the law in islam regarding those people that spreading the "bad news" / aib about me? what should i do? i once meet a woman in her house with intention to find a wife, i didnt told her about my vitiligo condition, but after a few days she stop welcoming me, because of this gossip about my vitiligo thats she know from my neghbourhood...what should i do to find a wife?
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, is His Slave and Messenger.
Such a disease is a trial, and we advise you to be patient with it, for which you will receive a good reward in this World and the Hereafter. For further benefit about the merit of patience in the face of trials, please refer to Fataawa 83577and 85445.
If there is somebody who speaks bad about you in your absence, that is, without doubt, forbidden backbiting. It is impermissible to ridicule or mock at someone facing a trial. If you learn or see anyone doing so, then advise him, remind him of Allaah, and frighten him of Allaah’s punishment, and the fact that Allaah may put him to the same trial, by way of punishment, and cure you from it. For further information about backbiting, see Fatwa 81748.
Besides, the congregational prayer is obligatory )for men(, according to the preponderant opinion of the scholars. So, it is impermissible for a Muslim man to miss it without a legitimate excuse, such as a contagious disease like leprosy or the like.
The disease mentioned above, being merely vitiligo, is not contagious, to the best of our knowledge; so it does not make it permissible for you to miss the congregational prayer. However, your patience and expecting the reward from Allaah for what you bear of harm in His way is better for you. Perhaps with time people would be accustomed to see you in this state, as seen in many cases.
As for marriage, it is possible that you would find a woman who accepts to marry you regardless of this disease. So, despair not, and rather keep asking Allaah to make things easy for you.
Although it is not obligatory to tell whomever you like to marry about your disease, it may be preferable, in order that she would be informed, and to avoid the causes of any future dispute.

salam i was married to a person who was abroad.i was having irregular period ,and after 1 month i got pregnancy in tube .and dr did my operation.after operation my husband told his mother that i have irregular cycle and we didnt tell them before marriage and they divorced me on this basis.still i was fertile but they didnt waited instead they called me useless and infertile.and after giving divorce they told everyone that i am infertile.they didnt gave my dowry back and also they didnt gave haq mehr.I want to ask u that if one girl has irregular period and they didnt tell before marriage is it a basis to divorce a girl and abuse her and mistreat her after 5 months of marriage.
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammadis His slave and Messenger.
A wife is not obliged to inform her husband before marriage if her menses is irregular, as this is not among the deficiencies which a person is obliged to inform about before marriage. Rather, even being barren is not among the deficiencies for which either spouse has the option to stay married or to divorce. So, neither the husband nor the wife is obliged to inform about him/her being sterile before the marriage contract but this is desirable. For more benefit on the deficiencies that affect marriage, please refer to Fatwa 90593.
Therefore, your husband should not have hastened to divorce as the medical treatment could be possible. Mistreating you and spreading the news that you are barren is contradictory to having good marital relations with one’s wife which the Sharee’ah advised the husband to have.
In any case, since what happened had happened, you should put the matter in the hands of Allaah, and it might be that there is goodness in separation and Allaah may grant you a better husband than your husband. Allaah Says )what means(: }But if they separate ]by divorce[, Allaah will enrich each ]of them[ from His abundance. And ever is Allaah Encompassing and Wise.{]Quran 4:130[
Nonetheless, your husband has to give you all your rights and we have already issued Fatwa 86603clarifying the rights of a divorcee. Among these rights is the dowry which you are fully entitled to after the consummation of the marriage whether or not he divorces you.
In case he does not give you your dowry, then you should take the matter to an Islamic court.

Question
A thirty-year-old woman married a fifty-five-year old widower who has three children from his previous marriage. She stipulated having children and he agreed, but after four years of marriage she did not have any yet. The doctors told her that there is nothing wrong with her, but her husband refuses to be examined, arguing that he already had three children with his late wife. What should she do especially since she wants to have children?
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammadis His slave and Messenger.
This case bears two possibilities: that the wife stipulated having children in any case or that she stipulated that he should utilize the available means and seek treatment to have children. If she has stipulated having children in any case, it is regarded as an invalid condition since she is stipulating what is not within the human being’s control or power. If she has stipulated that he should utilize the available means and seek treatment to have children, then it is a valid condition that does not contradict the very purposes of marriage in Islam; rather, it is one of the main purposes of marriage in Islam. Ma‘qil ibn Yasaarreported that the Prophet, said:“Marry the loving and prolific woman; for I will outnumber the nations by you.”
In another wording of the same narration, the Prophet, said:“I will boast of your large numbers in front of other nations )on the Day of Judgment(.”]Abu Daawood, An-Nasaa’i and Ahmad[
Usaamah ibn Shareeknarrated that the Prophet, said:“Seek treatment for there is no disease that Allaah The Almighty has created except that He also has created its treatment except one single disease: old age."]Abu Daawood and At-Tirmithi[
Hence, it is an obligation on this husband, and one of his wife’s rights over him, to undergo the necessary medical examinations and the due treatments to the best of his abilities. If he does so and they do not have children, then it is not incumbent on him to do anything further. However, if he insists on his refusal to undergo treatment, the wife has the right to seek divorce.
