Engagment, Doubt & clear, – * Ruling on engaged couple touching one another etc.












i searched through all the relevent sections but i could not find the answer for my question.so i am asking it here. i was engaged to my present wife. and during the engagement period (before Nikah) we used to meet and touch and kiss and fondle with each other.. etc . but we never committed an intercourse. and later on we married. now i came accross the ayat of sura Noor for which some scholars say that a couple who had committed Zinna with each other, then they can not marry each other. another related question is that in some parts of pakistan people use to renew their marraige contract (Nikah) without any sharee requirement. Is it permissible to renew ones Nikah if the earlier nikah is still valid.

The marriage contract is valid and it is no need from an Islamic point of view to renew it simply because of a doubt. But what is mentioned in the first part of the question, about kissing the woman during the engagement period – if this was before the marriage contract (‘aqd or nikaah), then it is haraam. The same applies to being stimulated manually by the woman. But if it was after the marriage contract then there is nothing wrong with kissing. With regard to adulterers marrying one another, there is nothing wrong with that, after waiting out an ‘iddah period and after both parties have repented. Allaah says (interpretation of the meaning):“Women impure are for men impure… and women of purity are for men of purity…” [al-Noor 24:26 - Yoosuf ‘Ali’ translation of the meaning]. Repentance is essential on the part of both, but it is not permissible to conclude the marriage contract until after the waiting-period and making sure that the woman is not pregnant as a result of zinaa. Once that has been established, there is no reason why they should not marry one another.
In your case, as you describe it in the question, there is no need to repeat the marriage contract, but you must both repent to Allaah for the forbidden relationship which you engaged in before you were married. And Allaah knows best.

General Doubt & clear, -

* The mahram relationship is not established if there is any doubt
about the number of breast feedings
-
My stepmother breastfed the son of my full brother but she is not sure
about the number of times she breastfed him, and she is not sure
whether this breastfeeding establishes the mahram relationship or not,
because this nephew wants to propose to my daughter.
Please advise us, may Allah reward you with good.

Praise be to Allah
As there is some doubt about the matter, and you do not know whether
it was five breastfeedings or four, or less than that, then the basic
principle is that the mahram relationship does not exist. As that is
the case, there is nothing wrong with this marriage, and this
breastfeeding concerning which there is some doubt is not considered
to establish the mahram relationship.

* Saying 'Bismillah' when a child starts eating

What is the ruling on saying 'Bismillah' each time that a child who
does not speak yet starts eating, that is, saying 'Bismillah' on his
behalf?

Praise be to Allah
We put this question to our Shaykh, 'Abd ar-Rahmaan al-Barraak (may
Allah preserve him) and he replied:
Say Bismillah for your action, not on behalf of the child. In other
words, you say Bismillah for feeding him, not on his behalf. This
should be done when beginning the action, and not with every morsel
you feed him.

* Ruling on covering up for someone who committed sin
-
What is the ruling on one who finds out that someone is persisting in
committing a sin, and he covers up for him and is content just to
advise him in the hope that he will be guided aright? Is he sinning
because he has not informed the relevant authorities about him?
-
Praise be to Allah
It is permissible to cover up for him if he is not one of those who
take the matter of sin lightly and he is not known to commit a lot of
sins or to commit prohibited actions. In this case, he should advise
him, tell him to fear Allah and warn him against doing it again.
But if he is a person who regularly commits sin and evil deeds, then
the one who finds out about it will not have discharged his duty until
he refers the matter to someone who can punish him in a way that will
deter him from persisting in it.
If the sin affects the rights of another person, such as if he sees
him stealing from someone's house or shop, or he sees him committing
adultery with the wife of So and so, then it is not permissible for
him to cover up for him, because that is a transgression against the
rights of another person, it affects that person's marriage and is a
betrayal of another Muslim. Similarly, if he finds out that he killed
or injured a Muslim, he should not cover up for him and cause the
rights of a fellow Muslim to be neglected; rather he should testify
against him to the relevant authorities, so that matter may be dealt
with. And Allah knows best.

Sifat al-Hajj wa’l-‘Umrah (Description of Hajj and ‘Umrah), Dought & clear, - * Delaying stoning the Jamaraat during the days of Tashreeq for a necessary reason











I stoned the Jamaraat on the second night at 10 p.m., but I had no choice in the matter. Is there any sin on me in that or not? There were two women and a man with me and they were all sick.

Praise be to Allaah.
Whoever delays stoning the Jamaraat on the eleventh day of Dhu’l-Hijjah until night comes – and delays it for a legitimate shar’i reason – and stones the Jamaraat at night, does not have to do anything to expiate for that.
Similarly if a person delays the Ramiy (stoning of the Jamaraat) on the twelfth day and does it at night, that is acceptable and there is no sin on him, but he has to spend that night in Mina and do the Ramiy on the thirteenth day after noon, because he did not do it on the twelfth day before the sun set. But to be on the safe side he should try to do the Ramiy during the day in the future.
And Allaah is the Source of strength. May Allaah send blessings and peace upon our Prophet Muhammad. ---
