Ramadan File, Dought & clear, - * Zakaah on jewellery that has been prepared for use.











My father-in-Law gave 560grams Gold ornaments at the time of Marriage in 1994. Also we got some gold jewels as a gift from relatives at the time of my wife delivery. I bought some Jewels for my wife in the mean time(1994-2004). Now my wife told me that we have to give 240 Grams gold as a Zakaat.
My Question is: I should pay Zakaat for all the above 3 categories ?.
Praise be to Allaah.
Jewellery that has been prepared to be worn and used as an adornment is something concerning which the fuqaha’ differed as to whether it is obligatory to pay zakaah on it. The Hanafis are of the view that it is obligatory to pay zakaah on it, but the majority of Maalikis, Shaafa’is and Hanbalis are of the view that it is not obligatory to pay zakaah on it.
The more correct view is that of the Hanafis, because of the great deal of evidence, including the following:
1 – The general meaning of the evidence which indicates that it is obligatory to pay zakaah on gold and silver, without differentiating between jewellery that is worn and other kinds.
2 – It was narrated that ‘Aa’ishah (may Allaah be pleased with her), the wife of the Prophet (peace and blessings of Allaah be upon him), said: The Messenger of Allaah (peace and blessings of Allaah be upon him) entered upon me and I was wearing rings of silver on my hand. He said: “What is this, O ‘Aa’ishah?” I said: “I made them to adorn myself for you, O Messenger of Allaah.” He said: “Have you given zakaah on them?” I said: “No.” He said: “The punishment for them in Hell is enough for you.”
Narrated by Abu Dawood, 155; classed as saheeh by al-Albaani inSaheeh Abi Dawood.
It was narrated from ‘Amr ibn Shu’ayb, from his father, from his grandfather, that a woman came to the Messenger of Allaah (peace and blessings of Allaah be upon him) and she had a daughter of hers with her. On her daughter’s hand were two thick bracelets of gold. He said to her: “Have you given the zakaah on these?” She said: “No.” He said, “Would you like Allaah to make you two bracelets of fire on the Day of Resurrection because of these?” So she took them off and gave them to the Prophet (peace and blessings of Allaah be upon him) and said: “They are for Allaah and His Messenger.” Narrated by Abu Dawood, 1563; al-Nasaa’i, 2479; classed as hasan by al-Albaani inSaheeh Abi Dawood.
Secondly:
You have to pay zakaah when you come to know that it is obligatory. As for the years that have passed when you did not know that zakaah was obligatory on jewellery that has been prepared for use, you do not have to pay zakaah on it.
Shaykh Ibn Baaz (may Allaah have mercy on him) was asked about a woman who has jewellery for adornment that stayed with her for years, then she came to know that it was obligatory for her to pay zakaah on it – did she have to pay zakaah for the past years? He replied: You have to pay zakaah from the time when you came to know that it is obligatory to pay zakaah on jewellery. As for the past when you did not know about that, it is not obligatory for you to pay zakaah, because the rulings of sharee’ah are only binding after one comes to know of them.
Fataawa Islamiyyah, 2/84.
With regard to a similar matter, he said (2/85):
She has to pay zakaah on her jewellery in the future each year if it reaches the nisaab (minimum threshold)… as for the years that have passed, before she came to know that zakaah must be paid on jewellery, she does not have to do anything about them, because she was unaware of that and because there is some element of confusion concerning this issue, since some of the scholars do not think that it is obligatory to pay zakaah on jewellery that is worn or is prepared to be worn. But the more correct view is that it is obligatory to pay zakaah on it, if it reaches the nisaab and one full (Hijri) year has passed, because of the evidence of the Qur’aan and Sunnah to that effect.
Thirdly:
Zakaah on jewellery that is prepared to be used applies to jewellery of gold and silver. Based on this, there is no zakaah on gems that you have bought, if they are not gold or silver.

Fourthly:
The zakaah must be paid by the owner of the jewellery, not by the husband.
Shaykh Ibn Baaz (may Allaah have mercy on him) said: “Zakaah must be paid by the owner of the jewellery. If it is paid by her husband or someone else on her behalf and with her permission, there is nothing wrong with that. The zakaah need not be paid from the jewellery itself, rather it is sufficient ti give the equivalent value each time one year passes, according to the value of gold and silver in the market when the year has passed.
Fataawa Islamiyyah, 2/85
But if the gift has been given to you both, and you have not given your share of it to your wife, then you have to pay the zakaah on your share, if it meets the nisaab, which is 85 grams.
The amount that must be paid is one-quarter of one-tenth or 2.5%, so for one hundred grams it is two and a half grams.

I had an erotic dream whilst fasting, but when I woke up I did not see anything to indicate that I had ejaculated. I had a dream without ejaculating. Should I do ghusl and complete my fast, or should I complete the fast without doing ghusl, or should I break my fast?.
Praise be to Allaah.
Firstly:
If a person has an erotic dream then when he wakes up he does not see any trace of semen on his clothes, then he does not have to do ghusl.
Ibn Qudaamah said inal-Mughni:
If a person thinks that he had an erotic dream, but he did not see any semen, then he does not have to go ghusl. Ibn al-Mundhir said: Every scholar from whom I acquired knowledge is agreed on this.
Umm Salamah narrated that Umm Sulaym said: “O Messenger of Allaah, does a woman have to do ghusl if she has an erotic dream?” He said: “Yes, if she sees water.” Agreed upon. This indicates that she does not have to do ghusl if she does not see water (discharge).
Secondly:
Fasting is not invalidated if one sees an erotic dream because this is something that the fasting person does not choose to do, it happens involuntarily.
Al-Nawawi said inal-Majmoo’:
If a person sees an erotic dream, that does not invalidate his fast, according to scholarly consensus, because it is involuntary, as in the case where a fly enters his mouth and he swallows it involuntarily. This is what is to be followed in this issue. With regard to the hadeeth narrated from the Prophet (peace and blessings of Allaah be upon him) which says “The one who vomits, has an erotic dream or has cupping done does not break his fast” – this is a weak (da’eef) hadeeth which should not be taken as evidence.
It says inal-Mughni(4/363):
If a person has an erotic dream, that does not invalidate his fast, because that does not happen by his choice. This is akin to if something enters his throat whilst he is sleeping.
Shaykh Ibn Baaz was asked inMajmoo’ al-Fataawa(15/276) about a person who slept during the day in Ramadaan and semen came out of him – does he have to make up this day?
He replied:
He does not have to make it up, because a wet dream does not happen by his choice, it is involuntary. But he does have to do ghusl if he sees semen.
Shaykh Ibn ‘Uthaymeen was asked inFataawa al-Siyaam(p. 284) about a person who has an erotic dream during the day in Ramadaan. He replied: His fast is still valid, and if he has an erotic dream that does not invalidate his fast, because it was involuntary. The Pen was lifted from him whilst he was asleep [i.e., his actions are not recorded and he will not be brought to account for them].
It says inFataawa al-Lajnah al-Daa’imah(10/274):
If a person has an erotic dream whilst he is fasting or in ihraam for Hajj or ‘Umrah, there is no sin on him and he does not have to offer expiation, and that does not invalidate his fast or Hajj or ‘umrah. He has to do ghusl from janaabah if any semen came out.

Ramadan File, Dought & clear, - *Ruling on fasting person who vomits a little.










Does vomiting in small quantity invalidates fasting? It was something between spitting / hawk ans vomiting. I am disposed that it was either very little vomitting /i.e. aI was not able to keep my water down/ or some spitting. Please provide with right Islamic enterpretation of this issue.

Vomiting refers to when food etc is expelled from the stomach outside the body.
With regard to whether this breaks the fast or not, the ruling depends on whether it was done deliberately or not. If a person vomits deliberately, this breaks the fast and he has to make up that day. If he cannot help vomiting and vomits involuntarily, then his fast is still valid and he does not have to do anything else. We have already discussed this in question no. 38023.
If a person needs to vomit because he is sick and vomiting will help him to recover, then it is permissible for him to do that, but he has to make up that day after Ramadaan, because Allaah says (interpretation of the meaning):
“and whoever is ill or on a journey, the same number [of days which one did not observe Sawm (fasts) must be made up] from other days”
[al-Baqarah 2:185]
According to the correct scholarly view, it makes no difference whether the amount of vomit is great or small. If a person vomits deliberately and only a small amount comes out, the fast is broken. It says inal-Furoo’: If a person makes himself vomit and vomits anything, then his fast is broken, because of the report of Abu Hurayrah: “Whoever cannot help vomiting does not have to do anything but whoever makes himself vomit deliberately has to make up that day.”Al-Furoo’, 3/49. This hadeeth was narrated by Abu Dawood, 2380; al-Tirmidhi, 720 – he said the scholars follow this. It was classed as saheeh by al-Albaani.
But there is a difference between spitting and vomiting. Spitting and hawking etc do not come from the stomach, so there is nothing wrong with expelling that matter. But vomiting comes from the stomach as explained above.
