Menstruation and Post-Natal bleeding, - Dought& clear, - * Ruling on blood that is passed before giving birth

A woman passed blood during pregnancy, five days before her nifaas started, during the month of Ramadaan. Is this blood menstrual blood or part of the blood of nifaas, and what should she do?
Praise be to Allaah.
If the matter is as it is described, and she saw blood when she was pregnant, five days before delivery, but she did not see any other sign that delivery was imminent, such as labour pains or contractions, then this blood is neither menstrual nor nifaas, but according to the correct view it is a kind of irregular bleeding. On this basis, she should not stop doing acts of worship, but she should fast and pray. If this bleeding is accompanied by other signs of impending labour, such as contractions and so on, then it is nifaas and so she should stop praying and fasting, then when she is clean from it after giving birth, then she can make up the fasts she has missed, but not the prayers.

What is the ruling on touching women with one's hand only during Ramadaan and the emission of semen as a result?.
Praise be to Allaah.
The ruling on touching non-mahram women is that it is haraam, during Ramadaan and at other times, whether that is touching with the hand only or actions that are more serious than that, because the Prophet (peace and blessings of Allaah be upon him) said: “If one of you were to be stabbed in the head with an iron needle, that would be better for him than his touching a woman who is not permissible for him.” Narrated by al-Tabaraani inal-Kabeer, 486; classed as saheeh by al-Albaani inSaheeh al-Jaami’, 5045.

Sins in general – including touching women – are more serious in Ramadaan. They detract from the reward of fasting, and may even spoil the fast altogether so that the fasting person gets nothing from his fast except hunger and thirst. Hence the fasting person is told most emphatically to avoid sin.
The believer should make the most of Ramadaan to set himself straight, to repent from sin and to turn to Allaah. The day when he fasts and the day when he does not fast cannot be the same.
Jaabir ibn ‘Abd-Allaah (may Allaah be pleased with him) said: When you fast, then let your hearing, sight and tongue fast and abstain from lies and haraam things, and refrain from harming your neighbour. Be tranquil and dignified on the day when you fast, and do not let the day when you fast and the day when you do not fast be the same.
Narrated by Ibn al-Mubaarak inal-Zuhd, 1308.

If a man shakes hands with a woman during the day in Ramadaan, and he ejaculates, his fast is invalidated, and there is no difference of opinion among the scholars on this point. He has to repent to Allaah from this sin, refrain from eating and drinking for the rest of the day, and make up that day’s fast later on.

With regard to emission of semen whilst fasting, if that happens without desire, e.g. because of sickness, then it does not affect the fast.
The Standing Committee was asked:
I suffer from seminal discharge during the days in Ramadaan without any wet dreams or engaging in the “secret habit” (masturbation). Does this have any effect on the fast?
They replied:
If the matter is as described, the emission of semen without any feelings of pleasure during the day in Ramadaan does not affect your fast, and you do not have to make up that day.
Fataawa al-Lajnah al-Daa’imah, 10/278.
But if the emission of semen is accompanied by desire, one of two scenarios applies:
1 – That happens because the man does something that provokes his desires, such as kissing his wife, shaking hands with a woman with desire, etc. This invalidates the fast and he must make up that day later on.
2 – The semen is emitted without the man doing anything, such as simply thinking about desire, or because of a wet dream. This does not invalidate the fast and his fast is still valid.
Shaykh Ibn Baaz (may Allaah have mercy on him) said:
With regard to the emission of semen as the result of desire, this invalidates the fast whether that happened because of touching or kissing or repeatedly looking, or any other reason that provokes desire, such as masturbation etc. With regard to wet dreams and thinking, these do not invalidate the fast even is semen is emitted as a result.

Is it permissible for me to sit with my wife’s sister, and does it break my wudoo’ if I touch her?
Please advise me, may Allaah reward you with good.
Praise be to Allaah.
It is haraam for you to sit with your wife’s sister or any other non-mahram woman on her own. The Messenger of Allaah (peace and blessings of Allaah be upon him) said: “No man is alone with a woman but the Shaytaan is the third one present with them.”(Narrated by al-Bukhaari, 9/290; Muslim, no. 1341; Ahmad, al-Musnad, 1/222 and 346).
It is haraam for a man to be alone with a woman who is not his mahram. Your wife’s sister is a stranger (i.e. non-mahram) to you, because if you were to divorce your wife, it would be permissible for you to marry her (her sister). So she is not one of your mahrams. With regard to breaking wudoo’, it is only broken by touching a woman with desire. If a man touches a woman with desire, this breaks his wudoo’, whether the woman is a non-mahram or otherwise. The kind of touching which breaks wudoo’ is physical touching with no barrier in between. This is what has been stated by the scholars. And Allaah knows best.

The verdict on shaking hands and touching a non-mahram woman (a woman who one can marry) has been stated earlier under Q# 2459.

Is it wrong to answer salam in big public bathrooms as long as one is not in the stalls/answering the call of nature?.
Praise be to Allaah.
The fuqaha’ are agreed that it is makrooh to give salaams to someone who is relieving himself, and it is also makrooh for him to respond. It was narrated that Abu’l-Jahm al-Ansaari (may Allaah be pleased with him) said: The Messenger of Allaah (blessings and peace of Allaah be upon him) came from the direction of Bi’r Jamal and was met by a man who greeted him with salaam. The Messenger of Allaah (blessings and peace of Allaah be upon him) did not return the greeting until he went to a wall and wiped his face and hands, then he returned the greeting.
Narrated by al-Bukhaari (no. 337) and Muslim (no. 369).
And it was narrated from Ibn ‘Umar that a man passed by when the Messenger of Allaah (blessings and peace of Allaah be upon him) was urinating. He greeted him, but he did not return the greeting. Narrated by Muslim (no. 370).
And it was narrated from al-Muhaajir ibn Qunfudh that he came to the Prophet (blessings and peace of Allaah be upon him) when he was urinating and he greeted him with salaam, but the Prophet (blessings and peace of Allaah be upon him) did not return the greeting until he had done wudoo’, then he apologised to him and said: “I do not like to mention Allaah, may He be glorified and exalted, except in a state of purity.” Narrated by Abu Dawood (17); classed as saheeh by Ibn Hajar in Nataa’ij al-Afkaar, 1/205; and by al-Albaani inSaheeh Abi Dawood.
Ibn al-Humaam al-Hanafi (may Allaah have mercy on him) said:
They were unanimously agreed that the one who is defecating is not obliged to return the greeting at that moment or afterwards, because greeting him is haraam, unlike the one who is in the hamaam (i.e., bathing), if he is wearing a waist wrapper. End quote.
Fath al-Qadeer, 1/248
Al-Nawawi (may Allaah have mercy on him) said:
Our companions said: It is makrooh to greet him [meaning the one who is relieving himself], and if someone does greet him it does not deserve a response, because of the hadeeths of Ibn ‘Umar and al-Muhaajir. End quote.
It says inal-Mawsoo’ah al-Fiqhiyyah(34/11):
The Maalikis, Shafaa’is and Hanbalis are of the view that it is makrooh to greet with salaam one who is defecating. The Hanafis also regarded that as makrooh. Ibn ‘Aabideen said: What is meant by that also includes urinating. He said: And it seems that this means it is haraam. End quote.
Based on that: if a person enters a public washroom and does not find anyone doing wudoo' at the sinks, it is makrooh for him to say salaams to those who are in the stalls where people relieve themselves. But if he finds that some of them have finished relieving themselves and have started to do wudoo’ or to wash their hands in the places prepared for that, there is nothing wrong with saying salaam to these people and they must return the greeting.
