Commentary on Hadeeth, - Dought & clear, - * The soundness and meaning of the hadeeth about performing Hajj every five years











We would like to know how to understand the hadeeth found in Saheeh At-Targheeb wat-Tarheeb (Al-Albani-RA)which states that (hadeeth qudsi) one whom Allaah has granted good health etc.. and does not visit His house every five years is mahroom (deprived). Does it refer to Hajj or 'umrah or both? And whatever the case may be, what are we to take from the hadeeth?.
Praise be to Allaah.
Firstly:
The text of the hadeeth:
It was narrated from Abu Sa’eed al-Khudri that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “Allaah says: ‘A person whose body I make healthy and to whom I grant ample provision but five years go by and he does not come to Me is indeed deprived.’”
Narrated by Abu Ya’laa, 2/304; al-Bayhaqi, 5/262
Secondly:
Discussion of the hadeeth:
Some of the scholars have discussed this hadeeth. Some of them – such as Ibn al-‘Arabi al-Maaliki – were of the view that it is mawdoo’ (fabricated). Others classed it as da’eef, such as al-Daaraqutni, al-‘Aqeeli and al-Subki. Ibn Hibbaan and Shaykh al-Albaani inal-Silsilah al-Saheehah(1662) are of the view that it is saheeh.
Thirdly:
Some of the scholars have interpreted this hadeeth as referring to Hajj or ‘Umrah. Based on this, al-Haythami included this hadeeth in his bookMawaarid al-Zam’aanunder the heading “Chapter concerning one who is well off but does not go for Hajj or ‘Umrah in five years.”
Mawaarid al-Zam’aan, p. 239.
Others interpreted it as referring to Hajj only, as al-Mundhiri included it in his bookal-Targheeb wa’l-Tarheebunder the heading, “Warning to one who is able to do Hajj but does not go for Hajj.”
Some of the scholars quoted this hadeeth as evidence that it is obligatory to perform Hajj once every five years for the one who is able to do that. This is a weak view, either because the hadeeth is weak (da’eef) and not saheeh, or because the hadeeth is to be understood as referring to what is mustahabb, not what is obligatory.
Al-Subki said:
The scholars are agreed that Hajj is an individual obligation upon every accountable, free Muslim who is able to do it, once in his or her lifetime, except for very few scholars who held different views, who said: It is obligatory once every five years, and they based that view on the report that the Prophet (peace and blessings of Allaah be upon him) said: “Every Muslim should come to the House of Allaah every five years.” This was narrated by Ibn al-‘Arabi. We say: Narrating this hadeeth is haraam, so how can a ruling be established based on it?
Al-Daaraqutni said: It was narrated through more than one isnaad, none of which are saheeh at all.

Al-Hattaab said:
Some of those who held an odd view said that it is obligatory every year, and it was narrated from some of them that it is obligatory every five years, because of the report according to which the Prophet (peace and blessings of Allaah be upon him) said: “Every Muslim should come to the House of Allaah every five years.” Ibn ‘Arabi said: Narrating this hadeeth is haraam, so how can a ruling be established based on it? Meaning that it is mawdoo’ (fabricated). Al-Nawawi said: This idea is contrary to the consensus of the scholars, so this odd view is to be rejected on the basis of the consensus of the scholars who came before those who held this odd view.
Even if we accept this hadeeth, then it is to be understood as meaning that it is mustahabb.

Kind Treatment of Spouses, - Dought & clear, - * There is no nothing wrong with getting pregnant whilst breast feeding












I have a son who is 19 months old, and I would like to know: is it permissible for me to get pregnant whilst I am breastfeeding my son? What is the ruling if I get pregnant and cannot continue breastfeeding him? Do I have to wait until I complete two years of breastfeeding, and then try to get pregnant?.
Praise be to Allaah.
It is permissible for a man to have intercourse with his wife who is breastfeeding, and there is nothing wrong with it. And there is nothing wrong with a woman breastfeeding when pregnant, because of the report narrated by Muslim (1442) from Judaamah bint Wahb al-Asadiyyah (may Allah be pleased with her), that she heard the Messenger of Allah (blessings and peace of Allah be upon him) say: “I was thinking of forbidding intercourse with a breastfeeding woman, until it occurred to me that the Romans and Persians do that and it does not harm their children.”
But the woman should examine her own case and her ability to put up with that, and she has to weigh up her duty towards her nursing infant and what she herself will need during the period of pregnancy. If she thinks that she may not be able to balance matters, or she thinks that it will harm her, then there is no reason why she should not put off getting pregnant for a while, so that she can finish breastfeeding, then start a new pregnancy.
Ibn Jibreen (may Allah have mercy on him) was asked:
I am a woman with six children, and in most cases I got pregnant before completing the breastfeeding of the previous child -- before the end of the two years -- and I want to use the so-called “coil” [intra-uterine device, a form of contraception that is inserted in the uterus] to prevent pregnancy for two years only. What is the Islamic ruling on that?
Answer:
There is no reason why you should not do that, if both spouses agree to it, and they are certain that it will not cause any harm to the uterus or prevent having any children in the future and so on.

Kind Treatment of Spouses, - Dought & clear, - " Her husband hits her and makes her bleed; should she call the police to protect her?











I have a husband who sometimes is very violent towards me and sometimes really hurt me and made me bleed, am i allowed to call police when he get violent with me?.
Praise be to Allaah.
Firstly:
The husband has to treat his wife kindly, because Allah says (interpretation of the meaning):
“and live with them honourably. If you dislike them, it may be that you dislike a thing and Allaah brings through it a great deal of good”
[al-Nisa’ 4:19].
And the Prophet (blessings and peace of Allah be upon him) said: “I enjoin good treatment of women.”
Narrated by al-Bukhaari (3331) and Muslim (1468).
And he said: “The best of you is the one who is best to his wife, and I am the best of you to my wives.”
Narrated by al-Tirmidhi (3895) and Ibn Maajah (1977); classed as saheeh by al-Albaani inSaheeh al-Tirmidhi.
It is not permissible for him to hit his wife in a way that causes her to bleed or hurts her. This is sinful aggression and enmity, because the basic principle is that the Muslim’s blood, honour, wealth and skin are sacred and protected, and it is not permissible to strike him except in cases where the Lawgiver has allowed striking that is not severe and does not cause harm, if there is the fear of wilful defiance (nushooz) on the part of the wife, and exhorting and shunning have not been to any avail.
Al-Bukhaari narrated from Abu Bakrah (may Allah be pleased with him) that the Messenger of Allah (blessings and peace of Allah be upon him) addressed the people and said: “Do you know what day this is?” They said: Allah and His messenger know best. He said: “Is it not the Day of Sacrifice?” We said: Yes indeed, O Messenger of Allah. He said: “What land is this? Is it not the sacred land?” We said: Yes indeed, O Messenger of Allah. He said: “Your blood, your wealth, your honour and your skin are sacred to you, as sacred as this day of yours, in this month of yours, in this land of yours. Have I not conveyed (the message)? We said: Yes. He said: “O Allah, bear witness.”
Secondly:
If the husband continues to beat his wife in the manner mentioned, it is permissible for her to ask for a divorce so as to relieve herself of the harm this is befalling her, and it is permissible for her to tell the police so that they can protect her against her husband's aggression by making him promise not to beat her and threatening him with imprisonment if he does that. But because the laws in the country where you are living may dictate punishments that are not permissible, such as forbidding the husband to enter his house or come near it, or ruling that the house belongs to the wife, or detaining the husband for a period that is not appropriate to his offence, we do not suggest that you should tell the police at first. Rather you should refer your case to an Islamic organisation such as al-Muntada al-Islami in London. Perhaps Allah will bring about reconciliation at their hands and your referring to them may bring about some good solution, or they may offer you some beneficial advice on how to deal with the police and the likely consequences of that.
If the husband continues like this and you do not want a divorce, then there is nothing wrong with telling the police whilst avoiding any unjust punishment. If it so happens that a verdict is issued in your favour that is not correct, such as barring him from entering the house, it is not permissible for you to act upon this verdict because the ruling of a judge – even if he is Muslim – does not make permissible something that is haraam, and does not make forbidden something that is halaal.
We ask Allah, may He be exalted, to guide your husband and set his affairs straight, and to guide you in your affairs.
