Fathwa - Husband is not obliged tosupport wife's child from previous marriage

Question
assalamualaikom,I am newly embraced in islam and marreid for the 2nd
time to a divorced muslim man.He have 2kids from his 1st wife now
living with us.We dont hve kids of our ownsince 5yrs of merriage.Back
in my christian life b4,i marreidfor the 1st time and hve ason but our
marreige didnt last.Raising my son till he reach the of 6yrs old i
leave him to the costudy of my aunt and decided to work abroad where i
met this divorcedmuslim man.Withouth a doubt i accept his proposal,i
converted and we get marreid.B4 we get marreid,me husband know that i
hve a son.My problem now i about my son.My husband not give me any
help or support for my son and telling methat its forbidden in islam
to support any christian.Me as a mother is too hard to hear that
fact.Rather he keep on telling me to bring my son here with us to live
together which i wanted too but,him as a father,a husband and a man,i
cannot trust my son to him,only reason why i refused to bring my here
with us.He is a hot tempered man and used to beat us,me and his own
kids for just simple mistakes.Not only simple beat but severely
beatingthat i cannot imagine how a man,a father who have fear to ALLAH
can dothat.Please advice me what to do about my son.I insist to my
husband if i can work, so i can send support to my son but he wont let
me..I know wives in islam is not allowed to work. Only at home.,but
what about my case? my son?Me as a mother, it hurts,because its like
im abandoning my own son.....pls advicE me,i want my son to be a
muslim soon inshALLAH...JAZZAKALLAH KHAYRAN
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify
that there is none worthy of worship except Allaah, and that Muhammad
isHis slave and Messenger.
First of all, we congratulate you upon the blessing of embracing Islam
as this isa great bounty that requires from a person tobe grateful to
Allaah for it. Among being grateful to Allaah for it, is to do allthat
makes you remain firm and steadfast [on this religion], like seeking
beneficial knowledge, performing good deeds and befriending righteous
and pious women.
You should know that thestatement of your husband that it is forbidden
in Islam to support any Christian is a statement that contradicts the
Sharee'ah, as the Sharee'ah permitted us to be kind to the non-Muslims
who are notbelligerent to Muslims; Allaah says (what means):{ Allaah
does not forbid you from those who do not fight you because of
religion and do not expelyou from your homes — from being righteous
toward them and acting justly toward them. Indeed, Allaah loves those
who act justly. } [Quran 60:8]
Also, you should know that a young child is ruled to be a Muslim as
long as one of his parentsis a Muslim. For more benefit, please refer
to Fatwa 81957 .
As regards spending on your son, then it is his father who is
obligated to spend on him, and your husband does not have to spend on
him unless he does so as an act of kindness, in which case he will be
rewarded for doing so. For more benefit, please refer to Fatwa 86141 .
In case his father is dead or insolvent and is unable to spend on him,
then it is his mother who is obligated to spend on him, as stated by
the jurists . Ibn Qudaamah said: " It is an obligation upon the mother
to spend on her child if he has no father; this is the same view of
Abu Haneefah and Ash-Shaafi'i. If the father is insolvent, then the
mother is obligated to spend on him, and she is entitled to ask his
father to reimburse her when he becomes solvent. "
Therefore, if you have nomoney to spend on him, then it is not an
obligation to endeavor to find work in order to spend on him and it is
not an obligation upon your husband to give youpermission to work.
However, since your husband does not object to your son living with
you, it might be more appropriate for you to accept it and be patient
with your husband so that you will be able to nurture your son and
guide him and educate him in a good manner; this is better than your
son being with his maternal aunt especially if she is a non-Muslim.
On the other hand, a husband is obligated to have good marital
relations with his wife and treat her in kindness;we have already
clarifiedthis in Fataawa 88304 and 86618 .
Indeed, it is a great evil for a husband to harm his wife and his
children and abuse them, as this ismisconduct and bad temperament. So,
you should advise him in a gentle manner and supplicate Allaah to
rectify him. In case you are harmed by staying with him, then you have
the right to ask for divorce, so you should resort to it if you think
that there is more benefitfor you in doing so, otherwise you should be
patient.

Fathwa - Ismaa'eel was ransomed with a ram, not with camels

Question
A/A when Ibraahim (AS) saw a dream, in which Allah had ordered him to
scarifies his son. Had Ibraahim (AS) slaughtered 100 camels in spite
of that on the first day, then again 100 camels on the second day. is
slaughtering of camel by him is true, if yes please give me its
reference
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify
that there is none worthy of worship except Allaah, and that Muhammad
, is His Slave and Messenger.
The correct opinion that most scholars adopt is what Ibn Katheer
stated that Ismaa'eel ) Ishmael ( was ransomed with a ram. It was
reported from Ibn 'Abbaas that he was ransomed with a mountain sheep.
At-Tabari reported that Mujaahid said: " He was ransomed with a ewe. "
We did not find anyone stating that he was ransomed with camels.
Rather, Al-Qurtubi confirmed that redemption was not done with camels
or cows, as he said: " That was a ram not a camel nor a cow. "
The story of the redemption of 'Abdul-Muttalib , where he ransomed his
son 'Abdullaah , the father of the Messenger of Allaah , indicates
that he fulfilled his vow with camels; as he had made avow to
sacrifice one of his adult sons and thus he ransomed him with 100
camels as reported inthe books of biography and history.

Using Food for Cosmetic Purposes

Allaah The Almighty has created man in the best shape and form; He
says (what means):
· } He Created the heavens and earth in truth and Formed you and
perfected your forms; and to Him is the [final] destination. { [Quran
64:3]
· } Who Created you, Proportionedyou, and Balanced you? { [Quran 82:7]
Allaah The Exalted created everything in the universe to suit the
nature of man as well as to be in harmony with the way Allaah
assembled him. Allaah The Almighty made everything on earth able to
meet the needs of man that vary and differ according to time and
place.
Hence, man lives in an environment and climate suitablefor him. Allaah
The Almighty Says (what means): } Do you not see that Allaah Has Made
subject to you whatever is in the heavens and whatever is in the earth
and amply Bestowed upon you His favors, [both] apparent and
unapparent? { [Quran 31:20]
One of the most important aspects of this life is food, which helps
man survive and obtain various benefits. It is the source of energy
and growth for the body and it resists diseases that weaken it. It was
proven throughmedicine and experimentation conducted throughout the
course of time that some kinds offood increase beauty and adornment
and help to remove defects that may afflict the body and affect its
beauty, or hide it.
There are two aspects of types of food that are involved in beauty:
The basic purpose for using themis treatment, and then other
beneficial uses evolved from this.
Examples of this are the following:
· Using honey to remove freckles that appear on the face.
· Using black seed to treat Alopecia and leprosy.
· Using lemon juice to remove thespots that surround the eyes, or any
spots on the face.
There is no doubt that this kind of treatment is lawful as long as it
is within the limits of Sharee'ah as these types of food are used as a
kind of treatment. The Prophet, , said: "Allaah has sent down both
disease and cure and appointed a cure for every disease. So treat
yourselves medically, but use nothing that isprohibited." [Abu
Daawood]
The second aspect is to use thesetypes of food for the sake of
beautification. Examples of these uses are the following:
· Using cucumbers to remove rough skin and wrinkles.
· Using parsley to help in purifyingthe skin and the face.
· Activating the skin by using strawberry.
This category is included in the general benefits that Allaah The
Almighty made lawful. This is according to the Fatwa that was issued
by the Permanent Committee for Islamic Research and Issuing of Fatwas,
as proven by the following:
First: Allaah The Almighty created everything on earth and made them
subject to us in all forms, whether for a necessary or a complementary
benefit, or a benefit that man uses to relax and renew his activity
and power for the best of this worldly life and the Hereafter.
There is no doubt that using these permissible types of food inseeking
beauty and adornment isone of the benefits that Allaah The Almighty
has created for us; He Says (what means):
· } It is He who Created for you all of that which is on the earth.
Then He Directed Himself to the heaven, [His being above all
creation], and Made them seven heavens, and He Is Knowing of
allthings. { [Quran 2:29]
· } Do you not see that Allaah has Subjected to you whatever is on the
earth and the ships which run through the sea by His command? And He
Restrains the sky from falling upon the earth, unless by His
permission. Indeed Allaah, to the people, is Kind and Merciful. {
[Quran 22:65]
Whoever contemplates upon these verses will find that this creation
and subjugation are not restricted to a certain aspect or one creature
alone, but they are general as they include everything that is of
benefit, as is indicated in the phrase which means } to you { .
Second: Beautification and adornment are among man's basic instincts
and are innate in the sons of Aadam. Thus, it is oneof the needs that
man seeks to fulfill. The Prophet, said: "The one who has in his heart
the weight of a mustard seed of pride will not enter Paradise." A man
said, "O Messenger of Allaah,everyone of us likes that his dressshould
be fine, and that his shoesshould be fine." The Prophet, , responded:
"Indeed, Allaah is Beautiful and He loves beauty." [Muslim]
The Prophet, , liked wearing perfume and had a bottle of perfume that
he would use. He would say: "Three things are rendered beloved to me
in the present life: women and perfume- and the coolness of my eyes
lies in performing prayer." [Ahmad]
The Prophet, , also had a Kohl (antimony) container for his eyes. He
used to oil his head and beard and comb them. He also used to have
certain clothes for meeting prominent persons and the chiefs of the
tribes. This is also required under Sharee'ah within the limits that
Allaah has set. Allaah The Almighty Says (what means): } And it is He
who Subjected the sea for you to eat from it tender meat and to
extract from it ornaments which you wear. And you see the ships
plowing through it, and [He Subjected it] that you may seek ofHis
bounty; and perhaps you will be grateful. { [Quran 16:14]
Moreover, Allaah The Almighty has disapproved of prohibiting anything
of this without evidence; He says (what means): } Say, 'Who has
forbidden the adornment of Allaah which He has Produced for His
servants andthe good [lawful] things of provision?' Say, 'They are for
those who believe during the worldly life [but] exclusively for them
on the Day of Resurrection.'Thus do We Detail the verses for apeople
who know. { [Quran 7:32]
At the same time, however, the following should be borne in mind:
· Using these things should be according to the need that achieves
what is needed. A person should not be extravagant while using them as
Allaah The Almighty has forbidden this.
· It is better to use other means that are, by default, used for
cosmetic purposes, as these types of food were not originally created
for cosmetic purposes. This is so as to not indulge in wastefulness.
Beautification and Adornment
The Sharee'ah has approved of this as indicated by the following:
· Advising man to look after his body and cleanliness, which is
considered one of the aspects of adornment. The Prophet, , said: "Five
acts are from Fitrah[natural disposition]: circumcision, shaving the
pubic hair, clipping the nails, plucking the hair under the armpits
and cutting the moustache short." [Muslim]
· The Prophet, , forbade the traveler who returns at night from
surprising his wife, so as not to see her in a bad condition. The
Prophet, , said in this regard: "[Do not return] until the woman
removes the pubic hair and combs her hair." [Muslim]
· The Prophet, , urged us to purify ourselves and made this
purification a reason for being forgiven by Allaah The Almighty in
some cases. For instance, the Prophet, , said: "Whoever takes a bath
on Friday, purifies himself as much as he can, then uses his [hair]
oil or perfumes himself, then proceeds [for the Friday prayer] and
does not separate two persons who are sitting together [in the
mosque], then prays as much as he can according to what was
predetermined by Allaah and remains silent while the Imam is
delivering the Khutbah, his sins between the present and the past
Friday would be forgiven." [Al-Bukhaari]
Third: The basic rule for adornment and beautification is
permissibility unless something that is prohibited under Sharee'ah is
used like impurities and alcohol that is part of the perfume industry
with a high percentage. Also, gold and silk for men and the use of
perfume for women at a time that she willpass by non- Mahram men.

Al-Khansaa': Poetess and Mother of Martyrs

According to the connoisseurs of Arabic poetry, there has never been a
woman whose poetry wasas replete with knowledge, or who was more
knowledgeable than Al-Khansaa' . The Prophet, sallallaahu 'alayhi wa
salam , used to ask her to recite her poetry, which he admired, in
front of him. She composed a great deal of poetry, and the most
eloquent of her poetry were odes in lamentation of her two brothers,
Sakhr and Mu'aawiyah, who were killed during the pre-Islamic era.
She spent the greatest part of herlifetime during the pre-Islamic
days, and when Islam appeared, she embraced it and went to the
Messenger of Allaah, sallallaahu 'alayhi wa salam , as a member ofthe
delegate of her tribe, Banu Sulaym.
She was recognized for her deep faith in Allaah The Almighty and His
Messenger, sallallaahu 'alayhi wa salam , and her zeal for Jihaad
(struggle) in the cause of supporting the truth. She attended the
Battle of Qaadisiyyah in 16 AH, in the company of her four sons.
Duringthe first part of the night, she said to them,
"O my sons! You have embraced Islam willingly and emigrated freely. By
Allaah, other than Whom there is none worthy of worship, you are the
sons of one man and one woman. I have never betrayed your father nor
have I disgraced your maternal uncle, nor have I dishonored yournoble
lineage, nor have I tampered with your parentage. You indeed know the
abundant reward prepared by Allaah The Almighty for the Muslims. It
should be known to you that the everlasting abode is better than the
perishable abode. Allaah The Almighty Says (what means): } O you who
have believed, persevereand endure and remain stationedand fear Allaah
that you may be successful. { [Quran 3:200]
Should tomorrow morning come upon you while you are safe, Allaah
willing, go early to fight your enemy with courage, and seek the
support of Allaah The Almighty against His enemies. When the battle
becomes fierce, betake yourselves amidst it and be eager to fight
bravely when the army is engaged in combat, perchance you receive gain
and honor in the abode of eternity."
Her sons set out in response to her advice, and continued fighting
while reciting poetry in Rajaz (a meter employed in Arabicpoetry), and
did their best in combat until they were all martyred. When the news
of their martyrdom reached her, shesaid, "Praise be to Allaah The
Almighty who honored me with their being killed in His cause, and I
hope that He will join me with them in the resting place of His
mercy." 'Umar ibn Al-Khattaab continued to give her the stipend of her
four sons, two hundred dirhams each, until he died.
Al-Khansaa' was a strong, believing woman, whose life was changed by
Islam and who was turned by faith into an exemplaryrole model for
Muslim women. When her brother, Sakhr, was killed in the pre-Islamic
period, she composed many poems lamenting him. Yet, after she embraced
Islam, she sacrificed her sons, the dearest of people toher, in the
cause of Allaah The Almighty. This is not strange. Thisis what Islam
does to those who embrace and love it. It turns theirlives into
avenues for doing good deeds, plants in them patience and faith, and
helps them to transcend afflictions and trials.
One day, Al-Khansaa' visited 'Aa'ishah, the Mother of the Believers
and she was wearing a vest that was made ofhair. 'Aa'ishah said to
her, "O Khansaa'! The Messenger of Allaah says that it is forbidden to
wear such clothes." She said,
"I did not know, but there is a story behind it. My father gave me in
marriage to a spendthrift man, who wasted his wealth. I went to [my
brother] Sakhr who divided his wealth into two halves, and gave me the
better part. When my husband did the same once again and I went to
Sakhr, my brother, who divided his wealth into two halves and once
again gave me the better part. His wife said to him, "Are you not
pleased to give her a half,why must you give her the betterportion?"
He said, "By Allaah, I shall never give her the worse, because I have
never been put to shame because of her; and should I die, she would
cut off her outer garment (in grief for me), and wear a vest of hair
instead."
Her real name was Tumaadhir bint 'Amr ibn Ash-Shareed ibn Al-Haarith
As-Sulamiyyah. She wasnicknamed Al-Khansaa' because of her bent nose
bone and narrow nostrils. Al-Khansaa' was a model of eloquence, and
faithful patience in aspiring for the reward of Allaah The Almighty,
and was a virtuous woman who continues to inspire generations.
