Fathwas, - * Old husband with strong sexual desire

Question
My husband is a 68-year-old religious man. His sexual desire is still very high. I am 64 years old. Our circumstances do not allow him to marry a second wife for social reasons like fear of creating bad relations between our children and my husband and possible adverse affects feared on our daughters' marriages. Hence, he does not prefer to do that even though he could financially afford it and hopefully be just between the wives also. His age and health condition are not good enough for him to fast except in Ramadan and occasional other fasts, like 8-9 Dhul Hijjah, 9-10 Muharram, and so on. Naturally, I also would prefer there not to be a second marriage. I have the following physical problems. )1( When I take the compulsory bath, I feel severe pain in my arm and shoulder area. )2( My sexual desire is also much less. I have three questions to avoid problems in our happy 40-year-long marriage, which are feared due to my two conditions )i( Short of a second marriage and fasting for reasons stated above, how can my husband's sexual desires be met in a halal way? )ii( Am I obliged to answer his frequent calls for sex? )iii( Can I make simply 'wipe' over the area where bathing causes severe pain when I need to take a compulsory bath?
Answer
All perfect praise be to Allaah, The Lord of the worlds. I testify that there is none worthy of worship except Allaah and that Muhammad, is His slave and Messenger.
The husband has the right to enjoy his wife sexually in any form of sexual enjoyment as long as he refrains from anal sex and intercourse during her menstruation. Allaah, The Exalted, says )what means(: }Your wives are a place of sowing of seed for you, so come to your place of cultivation however you wish and put forth )righteousness( for yourselves. And fear Allaah and know that you will meet Him. And give good tidings to the believers.{ ]Quran 2:223[ One form of lawful sexual enjoyment is for the wife to masturbate her husband, for instance. Please, refer to fatwa 87743.
The Muslim woman is obliged to respond to the request of her husband whenever he calls her to bed unless she has a valid reason for refusing, such as menstruation, postpartum bleeding, or severe harm, as we previously explained in fatwa 100429. The same ruling applies if she is preoccupied with performing a religious obligation; she is not obliged to respond to his request in this case as well. The Hanbali scholarAl-Buhootiwrote, "The husband has the right to enjoy his wife sexually in the vagina even if from behind her as long as no harm is incurred on her and it does not preoccupy her from performing a religious obligation..." ]Ar-Rawdh Al-Murbi‘[
The fact that you experience pain duringGhusl)ritual bath( or lack sexual desire does not constitute a valid excuse that allows you to refrain from answering his call to bed.
If you endure significant harm by using water, then you are obliged to wash the sound body parts with water normally and wipe )perform dry ablution( over the rest of the body. Haashiyat Ibn Qaasim 'ala Ar-Rawdh Al-Murbi‘ reads, "If the person fears incurring harm on himself by using water in purification )ablution or Ghusl(, then he should wash the sound body parts that would not be harmed by water and perform dry ablution for the rest so as to carry out the relevant obligation, without neglect or immoderation."
If you could not find any other way to help your husband guard his chastity yourself, then the solution is for him to have another wife. It is allowable for the Muslim man to take up to four wives if he is able to observe justice and equality among them. Allaah, The Exalted, says )what means(: }...then marry those that please you of )other( women, two or three or four. But if you fear that you will not be just, then ]marry only[ one...{ ]Quran 4:3[ It should be noted that taking a second wife may be obligatory on the husband in case he fears the temptation to commit immorality if he did not take another wife.
Ibn Qudaamahwrote, "As far as the religious ruling on marriage, people are of three categories: a person who fears the temptation of committing immorality for himself if he does not get married; it is incumbent on such a person to get married according to the majority of scholars because he is obliged to guard his chastity and shield himself from committing the unlawful, which is achieved through marriage..."
Shaykh Ibn ‘Uthaymeenwrote, "Hence, we believe that it is better and more prudent for the Muslim man to settle for one wife. However, if he believes that he would not be able to guard his chastity when marrying one wife only, then we advise him to take a second wife, or even a third and a fourth, until he attains serenity and becomes able to lower his gaze, guard his chastity, and find peace of mind..." ]Zaad Al-Mustaqni'[

Finally, your husband should be supported and helped to accomplish this objective, not face obstacles laid down by his wife or his sons or daughters.

Da'eef (weak) hadeeths, Dought & clear, - * Status of Hadeeth: “O ‘Ali, do not sleep until you do five things”

I read this hadeeth (narration), and I want to know if it is authentic or not?
The Messenger of Allah (peace and blessings of Allah be upon him) said: “ O ‘Ali, do not go to sleep until you have done five things, which are: reading the entire Quran, giving 4,000 dirhams in charity, visiting the Ka’bah, protecting your place in Paradise, and pleasing your opponent.” ‘Ali (may Allah be pleased with him) said: How can I do that, O Messenger of Allah? The Messenger of Allah (peace and blessings of Allah be upon him) said: “ Do you not know that if you recite Surah al-Ikhlas (Qul Huwa Allahu Ahad) three times, then you will have recited the entire Quran; and if you recite al-Fatihah four times, then you will have given 4,000 dirhams in charity; and if you say La ilaha ill-Allah wahdahu la shareeka lah, lahu’l-mulk wa lahu’l-hamd yuhyi wa yumeet wa huwa ‘ala kulli shay’in qadeer (there is no God but Allah alone, with no partner or associate, His is the Dominion and to Him be praise, He gives life and gives death, and He has power over all things) 10 times, then you will have visited the Ka’bah; and if you say: La hawla wa la quwwata illa Billah il-‘Aliy il-‘Azeem (there is no power and strength except with Allah, the Most High, the Most Great) 10 times, then you will have protected your place in Paradise; and if you say Astaghfir-Allah al-‘Azeem alladhi la ilaha illa huwa al-Hayy al-Qayyoom wa atoobu ilayh (I seek forgiveness from Allah, the Almighty, besides Whom there is no god, the Ever Living, the Self Sustaining) ten times, then you will have pleased your opponent?”

Praise be to Allah.
This hadeeth is not narrated in any of the reliable books of hadeeth; rather it is a fabricated hadeeth which is falsely attributed to the Messenger (peace and blessings of Allah be upon him). The scholars (may Allah have mercy on them) stated that the advice that is attributed to the Prophet (peace and blessings of Allah be upon him) and that he allegedly gave to ‘Ali (may Allah be pleased with him), and everything that is supposedly addressed by the Messenger to Ali is all fabricated, apart from his words: “O Ali, you are to me like Haroon was to Moosa, but there is no Prophet after me.” Among those who have stated this are: Shaykh Mulla ‘Ali al-Qari in al-Asrar al-Marfoo’ah fi’l-Akhbar al-Mawdoo’ah, which is also known as al-Mawdoo’at al-Kubra; Shaykh Isma’eel al-‘Ajlooni in his book Kashf al-Khafa’ wa Muzeel al-Ilbas. Hence I warn my Muslim brothers against being deceived by this hadeeth and similar fabricated reports, or working to print them or publish them among the Muslims, because this is misguiding the masses and deceiving them, and telling lies about the Messenger of Allah (peace and blessings of Allah be upon him), concerning which a stern warning is issued to the one who does so deliberately, as he (peace and blessings of Allah be upon him) said in this saheeh (authentic) hadeeth: “Telling a lie about me is not like telling a lie about anyone else. Whoever tells a lie about me deliberately, let him take his place in Hell.” And he said: “Whoever narrates from me a saying knowing that it is false, then he is one of the liars.”
In the saheeh reports from the Messenger (peace and blessings of Allah be upon him) that are compiled in the reliable books of hadeeth, the Saheehs, Sunans and Musnads, there is sufficient material for the one whom Allah guides to goodness, and there is no need to resort to the reports of liars and fabricators. I ask Allah to enable us all to acquire beneficial knowledge and do righteous deeds, and to keep us all away from the path of misguidance and deviation, for He is All Hearing, Ever Near.

I found in a chat room a strange du’a. The poster said: “Whoever recites this du’a at any time, it is as if he has done Hajj 360 times, and read the entire Quran 360 times, and freed 360 slaves, and given 360 dinars in charity, and given relief to 360 people in distress...” etc. I looked on Google, and I was astonished to see how widespread this du’a is, but I could only find a very few websites or pages which responded with fatwa number 21084 from the Standing Committee for Scholarly Research and Issuing Fatwas.
But the problem is: does simply writing this phrase -- Standing Committee for Scholarly Research and Issuing Fatwas -- underneath the answer give credibility to the fatwa, or must we verify the source and check whether the Standing Committee for Scholarly Research and Issuing Fatwas is in fact the source of the fatwa?
What is the proper way to verify the fatwas of the Standing Committee for Scholarly Research and Issuing Fatwas on the Internet and to find out whether it is in fact responsible for issuing a particular fatwa?
Is there an official and trustworthy site dedicated to fatwas of the Standing Committee for Scholarly Research and Issuing Fatwas on the Internet?
Is a person sinning if he publishes a fatwa without verifying the source or mentioning it?

Firstly:
The Standing Committee for Scholarly Research and Issuing Fatwas in the Kingdom of Saudi Arabia is one of the respected scholarly committees of current times. It includes a number of senior scholars from this country, and it has a high level of credibility in scholarly and Islamic circles. It has done a great deal of work in explaining the rulings of sharee’ah (Islamic law) to the people and issuing fatwas (verdicts) having to do with all aspects of life. Al-Shaykh Ahmad ibn ‘Abd al-Razzaq al-Duwaysh has compiled the fatwas issued by the committee, and the first group of them has appeared in 26 volumes; the second group has appeared in six volumes. This is one of the most important references that may be used by people and seekers of knowledge today in the study of contemporary fiqhi (jurisprudential) issues.

Secondly:
With regard to the du’a mentioned in the question, a genuine fatwa has been issued concerning it by the Standing Committee, and it has been published in the book which includes a number of their fatwas. We will quote to you here that which has to do with this du’a.
It says in Fatawa al-Lajnah al-Daimah (24/281-284), fatwa no. 21084:
Praise be to Allah alone and peace and blessings be upon the one after whom there is no Prophet.
The Standing Committee for Scholarly Research and Issuing Fatwas has examined that which was sent to the Chief Mufti by Dr. Muhammad ibn Sa’d al-Shuwayir and was referred to the Council of Senior Scholars no. 3598, dated 9/7/1420 AH. The enquirer stated that one of the citizens brought a flyer which he says he found in the mosque where he prays, and he is asking for a fatwa concerning it. In this paper it says the following:
“La ilaha ill-Allah al-Jaleel al-Jabbar, La ilaha ill-Allah al-Wahid al-Qahhar, La ilaha ill-Allah al-‘Azeez al-Ghaffar, La ilaha ill-Allah al-Kareem al-Sattar, La ilaha ill-Allah al-Kabeer al-Muta’al. La ilaha ill-Allah wahdahu la shareeka lah, ilahan wahidan rabban wa shahidan, samadan wa nahnu lahu muslimoon. La ilaha ill-Allah wahdahu la shareeka lah, ilahan wahidan rabban wa shahidan nahnu lahu ‘abidoon, La ilaha ill-Allah wahdahu la shareeka lah, ilahan wahidan rabban wa shahidan, nahnu lahu qanitoon, La ilaha ill-Allah wahdahu la shareeka lah, ilahan wahidan rabban wa shahidan, nahnu lahu sabiroon. La ilaha ill-Allah Muhammad rasool-Allah, ‘Ali wali-Allah. Allahumma ilayka wajahtu wajhi, wa ilayka fawwadtu amri, wa ‘alayka tawakkaltu ya arham al-rahimeen. (There is no god but Allah, the Majestic, the Exalted in Might, there is no god but Allah, the One, the Subduer, there is no god but Allah, the Almighty, the All-Forgiving, there is no god but Allah, the Most Generous, the Concealer, there is no god but Allah, the Most Great, the Most High. There is no god but Allah alone with no partner or associate, one God, Lord and Witness, Eternal, and we submit to Him. There is no god but Allah alone, with no partner or associate, One God, Lord and Witness, and we worship Him; there is no god but Allah alone with no partner or associate, one God, Lord and Witness, and we are devoted to Him; there is no god but Allah alone with no partner or associate, one God, Lord and Witness, and we are patient for His sake. There is no god but Allah, Muhammad is the Messenger of Allah, and ‘Ali is the wali (close friend) of Allah. O Allah, to You I turn my face and to You I delegate my affairs, and in You I put my trust, O Most Merciful of those who show mercy.
It was narrated from the Messenger of Allah (peace and blessings of Allah be upon him) in the hadeeth that he said: “Whoever recites this du’a at any time, it is as if he has done Hajj 360 times, and read the entire Quran 360 times, and freed 360 slaves, and given 360 dinars in charity, and given relief to 360 people in distress.” No sooner had the Messenger of Allah (peace and blessings of Allah be upon him) spoken this hadeeth, but al-Ameen Jibreel (peace be upon him) came down and said: O Messenger of Allah, any slave of Allah, male or female, among your ummah, O Muhammad, who recites this du’a, even if it is only once in his lifetime, by my holiness and majesty, I guarantee to him seven things:
1. I will relieve him of poverty
2. I will protect him from the questioning of Munkar and Nakeer
3. I will help him to pass over al-Sirat (the bridge over Hell)
4. I will protect him from sudden death
5. I will make it forbidden for him to enter Hell
6. I will protect him from the squeezing of the grave
7. I will protect him from the wrath of the unjust ruler.
The Messenger of Allah (peace and blessings of Allah be upon him) spoke the truth.
After studying this matter, the Committee for Issuing Fatwas replied as follows:
This du’a which is attributed to the Prophet (peace and blessings of Allah be upon him) is a false du’a, which has no basis in the Book of Allah or the Sunnah (teachings) of His Prophet (peace and blessings of Allah be upon him). The hadeeth which speaks of its virtue is a false and fabricated hadeeth. We have not found any of the imams of hadeeth who narrated it with this wording.
The indications that it has been fabricated are clear for a number of reasons including the following:
1. This supplication and its implications are contrary to sound commonsense and that which has been clearly narrated in the Book of Allah and the Sunnah of His Prophet (peace and blessings of Allah be upon him). That is because of the suggestion of these huge numbers of reward for the one who recites this supplication.
2. It includes the phrase “‘Ali is the wali (close friend) of Allah.” Undoubtedly the Ameer al-Mu’mineen ‘Ali ibn Abi Talib (may Allah be pleased with him) is one of the close friends of Allah, in sha Allah, but singling him out for mention to the exclusion of others is a Rafidi (Shiite) idea.
3. It states that one of the effects of this supplication is that the one who recites it will enter Paradise even if he commits major sins or does anything that is contrary to faith. This is invalid and unacceptable according to reason and sharee’ah (Islamic law).
Based on this, what every Muslim should do is pay no attention to this flyer, and destroy it, and warn people against being deceived by this or similar things. He has to verify matters of religion and ask people of knowledge about anything that he is confused about, so that he will worship Allah with insight and will not fall victim to charlatans and weak souls who want to divert the Muslims from that which concerns them of both religious and worldly matters, and make them attached to illusions and innovations that have no validity.
Standing Committee for Scholarly Research and Issuing Fatwas
It is essential to point out here the necessity of verifying the attribution of fatwas to their authors before spreading them or announcing them. Indeed, this is essential in everything that one attributes to someone else. Allah says (interpretation of the meaning):
“And follow not (O man, i.e., say not, or do not, or witness not) that of which you have no knowledge. Verily, the hearing, and the sight, and the heart of each of those ones will be questioned (by Allah).”
[al-Isra 17:36]
If people responded to this divine command, it would suffice them against a great deal of division and conflict which brings nothing but evil.
You may verify that this fatwa was indeed issued by the Standing Committee, either by reading their books if that is possible for you or you have a copy of them, or by reading about it on the official website of the General Presidency of Scholarly Research and Ifta, the link to which we have mentioned above, or if it is quoted to you from them by a trustworthy scholar or on a trustworthy website.
