Fathwa, - He did not tell his wife that he had a fertility problem

I have been married for past 6 years and we have no kids due to medical reasons. We are staying abroad in gulf from the time of marriage. Also, due to medical reasons the relationship is reduced. We have undergone lot of medical treatment for having kids but the result was negative. Prior to my marriage i was undergoing treatment with the doctor, the biggest blunder we did was not informing about the treatment to my wife and her parents. My wife was working before but now she is at home and feels very lonely and misses having kids. Kindly advise what should be done since my wife is very depressed & unhappy and i feel like i have cheated her.
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammadis His slave and Messenger.
Being sterile is not considered among the defects the give the other party the right to invalidate the marriage contract; it is for this reason that the majority of the juristsare of the view that it is not an obligation )upon the husband( to inform the wife about it.
Hence, we advise you to continue seeking medical treatment. You and your wife should not give up hope; rather, you should supplicate Allaah as much as possible as He answers the supplication of people in distress. It is Allaah Who blessed the ProphetIbraaheem)Abraham(withIsmaa’eel)Ishmael( andIshaaq)Ishaq( while he was an old man, and He blessedZakariyya)Zachariah( withYahia)John( and He amended his wife for him and she became fertile after having been barren; may Allaah exalt the mention of all the Prophets and Messengers.
Indeed, the matter of having children is in the hands of Allaah; Allaah Says )what means(: }To Allaah belongs the dominion of the heavens and the earth; He creates what He wills. He gives to whom He wills female ]children[ and He gives to whom He wills males. Or He makes them ]both[ males and females, and He renders whom He wills barren. Indeed, He is Knowing and Competent.{]Quran 42:49-50[
Also, we advise both of you to seek the forgiveness of Allaah as much as possible as this is a means of having children; Allaah Says about the ProphetNooh]Noah[ )what means(: }And said, Ask forgiveness of your Lord. Indeed, He is ever a Perpetual Forgiver. He will send ]rain from[ the sky upon you in ]continuing[ showers. And give you increase in wealth and children and provide for you gardens and provide for you rivers.{]Quran 71:10-12[
On the other hand, it is permissible for you to look for a means to have children by artificial insemination as this is permissible provided some Islamic conditions are met as clarified in various Fatwas.

Fathwa, - Diseases that may affect marital life should be disclosed before concluding the marriage contract

I have a disease that affects the liver that is transmitted through blood, sex or childbirth. I caught it due to lack of antisepsis at birth. This disease usually appears between forty and sixty years of age, and once it appears, the affected person dies some days later. As yet, no remedy has been found but there is a vaccine against it. At present, I am 23 years old. I have a job and would like to marry. My question is: could I vaccinate the woman whom I would like to marry without telling her about the reality of my disease? If your Fatwa is in the negative, then, I would not be accepted. Is it lawful to spend my entire life without marriage? Is this not a violation of the rules of a sound innate disposition? I am content with the fate that Allaah The Almighty has decreed for me. What should I do to restrain my sexual desire and not fall into sin?
Answer
All perfect praise be to Allaah, the Lord of the worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, is His Slave and Messenger.
A faithful believer must accept the fate that Allaah The Almighty decrees for him, and should do so patiently while hoping for the reward from Allaah The Almighty, keeping in mind that there is wisdom known only by Allaah The Almighty that lies behind whatever diseases and trials he is exposed to, and that they are a means to raise his rank and blot out his sins.
Undoubtedly, the disease that has affected you is a kind of trial, and perhaps Allaah The Almighty would cure you of it by virtue of your obedience and piety, and prayer to Him to cure you and restore you to health, since nothing but supplication can avert fate, as confirmed in the noble Prophetic Hadeeth )narration(.
As for your intention to marry and your question whether or not to tell your would-be wife about this disease, let us say that if it is certain that you are affected by that disease, due to your confidence in the validity of analyses and tests, on the basis of their variety and multiple sources, we are of the view that you should tell the woman whom you would like to marry about this. This is necessary so that she is fully aware of the matter, especially since you are going to vaccinate her against the disease, and you must have her permission before you give her the vaccine. Furthermore, after marriage, the symptoms of the disease might appear, which would put the family life to risk, for by then the woman would perceive to what extent she has been deceived and cheated.
No doubt, you would never accept to be treated as such by your wife. If you marry a woman and after marriage you detect that she is suffering from such a disease and that she has hidden this fact from you, of a surety, your impression would be that you have been cheated and deceived. It is narrated in a Prophetic Hadeeth: "None of you has believed until he likes for his brother what he likes for himself." ]Al-Bukhaari and Muslim[
We advise you to endeavor to treat yourself, and do your best to search for a remedy, and have confidence in Allaah The Almighty, seek refuge in Him, and treat yourself with the things which He made curative like the water of Zamzam, honey, black seed and other such things. Many sick persons whose disease was hopeless took refuge in that, with reliance on and confidence in Allaah The Almighty, and they fully recovered.
If you intend to marry, it may be that Allaah The Almighty would place in your way a righteous woman who accepts to marry you regardless of your disease.
We ask Allaah to cure you, restore you to health, and make your affairs easy.

Fathwa, - Marrying a woman who lost her virginity when raped

I am a young Muslim man. I met a girl whom I intend to marry. She told me that she was deflowered after being raped by her uncle. This matter made me change my mind concerning marrying her. What do you advise?
Answer
All perfect praise be to Allaah, the Lord of the worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, is His Slave and Messenger.
If you are sure of the truthfulness of this girl, then, it is permissible for you to marry her. Moreover, if you marry her, you will be preserving her honor. She told you what had happened, which indicates her truthfulness especially that she named her uncle as the perpetrator. It is most unlikely to accuse her uncle if she is a liar. If she was lying, she was more likely to claim that she was raped by any other man or to tell you that she lost her virginity due to a jump or a fall, and so on. In general, you are more knowledgeable regarding the condition of the girl, her truthfulness and circumstances.
We would like to bring to your attention that is it impermissible for a man and a woman to have a relationship before marriage.

Welcome to Islam, - The message of the messengers

| Allaah, the All Wise, All Knowing, All Merciful and Just, created this Universe in order to test and examine His obedient slaves and reward them, and to punish the disobedient. He Says )what means(:"We did not create the heavens and the earth and that between them in play. We did not create them except in truth, but most of them do not know."]Quran 44: 38-39[
Allaah also made clear the main goal for the creation of mankind, Saying )what means(:"I did not create the Jinn and Mankind except for My worship"]Quran 51: 56[
Allaah, the Exalted, did not leave His slaves to rely upon their intellect and inclination to guide them to the correct way; rather He sent them Messengers as bringers of good tidings and warners. He sent the revealed Books with them to be a reference in those matters wherein they disagreed, so that no excuse would remain for the people and the proof would be established against them. Thus, after sending the Messengers, there would be no further excuse for people before Allaah.
Indeed, their mission covered every good and banished every evil. They brought to humankind everything needed for their well being and happiness in this world and the Hereafter. There is nothing good, which they did not inform the people about and nothing evil that they did not warn the people against.
‘Abdullaah bin `Amr bin Al-`Aas, may Allaah be pleased with him, said that the Prophet, sallallaahu ‘alayhi wa sallam, said:"There was never a Prophet before me except that it was a duty upon him that he should guide his nation to every good that he knew and warn them against every evil that he knew…"]Muslim[
Indeed, calling to Allaah was the mission of the Messengers in order to bring the people out from darkness into light. There are many basic principles upon which their calls were based, which were the starting point for calling to Allaah. These fundamental principles are:
1. Tawheed )Monotheism(
2. Prophethood
3. The Hereafter
Every book revealed by Allaah gave great importance to these points. The most important and sublime of these three principles and the most fundamental of them all is Tawheed )Oneness( of Allaah.
Allaah Says )which means(:"And We certainly sent into every nation a Messenger, )saying(: 'Worship Allaah and avoid Taaghoot )false objects of worship(.' "]Quran 16: 36[
Allaah has informed us about some of the Prophets, may Allaah exalt their mention, and how they faced their people. We see that all of them proceeded upon the universal way laid down by Allaah and followed the methodology Allaah established for all of them. Not a single one of them is at variance with it, Allaah Says )which means(:"And We had certainly sent Nooh to his people, )saying(: 'Indeed, I am to you a clear warner, that you not worship except Allaah. Indeed, I fear for you the punishment of a painful Day.'"]Quran 11: 25-26[
The noblest of all Prophets and the last of them, Muhammad bin ‘Abdullaah, sallallaahu ‘alayhi wa sallam, )who was sent with the greatest, most complete and comprehensive message(, began with what all the Prophets, may Allaah exalt their mention, started their Da’wah )call( -- calling to the 'Aqeedah )creed( of Tawheed )Oneness of Allaah(, and calling for all worship to be made purely and sincerely for Allaah alone. Allaah's Messenger, sallallaahu ‘alayhi wa sallam, started with the principle: 'Witness that none has the right to be worshipped except Allaah.'
Allaah Says )what means(:"Say, )O Muhammad(: 'O mankind, indeed I am the Messenger of Allaah to you all, )from him( to Whom belongs the dominion of the heavens and the earth. There is no deity except Him; He gives life and causes death.' So believe in Allaah and His Messenger, the unlettered Prophet, who believes in Allaah and His words, and follow him that you may be guided."]Quran 7: 158[
The verses in this regard are many, what we quote here is just one example. With regard to the Sunnah )traditions and approved actions of Prophet Muhammad, sallallaahu ‘alayhi wa sallam(, there are many clear indications that Allaah's Messenger began his call to Islam with Tawheed.
1.`Amr bin Abasah As-Sulami, may Allaah be pleased with him, said:"During the times of ignorance … I heard of a man in Makkah who received revelation. So I set upon my riding beast and came to him. At that time he was in hiding, due to the oppression of his people. So I behaved in a way that enabled me to gain access to him in Makkah. I said to him: "Who are you?" He replied: "I am a Prophet.' So I said: "And what is a Prophet?' He said: 'Allaah has sent me as a Messenger.' So I said: 'And what is it that He has sent you with?' He said: 'I have been sent to order the joining of ties of relationship, to break the idols, so that Allaah is worshipped Alone and nothing at all is associated in worship along with Him."]Muslim[
2.At the time of the peace of Hudaibiyyah, Hiraql )Heraclius( asked Abu Sufyaan some questions about Allaah's Messenger, among which he asked:"What does he )Muhammad( command you?" Abu Sufyaan replied: "He says, 'Worship Allaah Alone and do not worship anything else along with Him, and abandon what your fathers say. He also orders prayers, charity, and the joining of the ties of relationship.'"]Al-Bukhaari[
Consequently, the Prophets, may Allaah exalt their mention, did not come to bring about the downfall of one State to replace it with another. They did not seek sovereignty, nor did they organize political parties for this reason. Rather, they came for the guidance of humankind, to save it from misguidance and Shirk )polytheism(, and to take them out of darkness into light.
In this regard Prophet Muhammad, sallallaahu ‘alayhi wa sallam, gave an example about himself. He, sallallaahu ‘alayhi wa sallam, said:"The similitude of me and the message with which Allaah has sent me, is like a man who came to some people and said: ‘I have seen the enemy forces with my own eyes and I am a mere warner )to you(. So, save yourselves, save yourselves!’ A group of his people obeyed him and went out at night, slowly and steadily and was safe; while another group belied him and stayed in their place until the morning when the army destroyed them. Such is the similitude of those who obey me and follow what I have brought )i.e., Message( and of those who disobey me and belie the Truth which I have brought."]Al-Bukhaari, Muslim and others[
The Message of the Messengers, by the Mercy of Allaah, revives and enlightens the believer’s soul. This enlightenment is the revelation of Allaah, which leads mankind from the darkness of Shirk )polytheism( and ignorance to the Light of Truth and Islam:"Allaah is the ally of those who believe. He brings them out from darkness into the light."]Quran 2: 257[
The Messenger and the Message are evidence against the disbelievers
Allaah sent His Messengers and His Books so that there can be no excuse for mankind on the Day of Judgment. The Quran says )what means(:")we sent( Messengers as bringers of good tidings and warners so that mankind will have no argument against Allaah after Messengers."]Quran 4: 165[
The Message of Allaah deals with the rights of Allaah on His bondsmen, the rights of man on His Creator, The Oneness of Allaah and its influence on the creation, knowledge, admonition, the wisdom behind the creation, righteousness, mutual interactions, refutation of incorrect beliefs and deviations, lawful and unlawful, migration and Jihaad. In totality, it is the complete code for righteous living, which results in delight, pleasure and harmony in this life and the Hereafter. |

Welcome to Islam, - The Oneness of Divinity

| Is there any convincing explanation for the secret of existence? The theory currently in vogue says that all existence is accidental and haphazard. In my opinion, only two ideologies remain in the realm of the probable. We can attribute life and universe to chance, and therefore, existence is meaningless. Alternatively, there is meaning of such magnitude to life, that, largely, it escapes us.
When we observe the orderly movements of the stars and planets, the regularity of the seasons, the uniformity and control of the law of nature over matter, energy and life, we realize that everything in the universe is knit into a single harmonious system.
Any one who looks at this great phenomenon and comes to the conclusion that it evolved on its own or by accident, must question his reasoning. Even an old watch, which has a simple mechanism of pulleys implies that there must be a watchmaker.
Albert Einstein, the most famous scientist of modern times, tells us: "Everyone who is seriously involved in the pursuit of Science becomes convinced that a Spirit is manifest in the Law of the Universe, without concluding that there must be Divine intent behind it all. Speaking for myself, I can only say that the grandeur of the Cosmos serves to confirm my belief in the certainty of the Creator." In the most quotable quote, he said about the emergence of the universe by chance: "God does not play dice."
In fact, throughout history, humankind as a whole has never denied the existence of a Creator. However, cultures have misunderstood His Nature and associated a mass of mythology with Him.
There is a Force in action to keep everything in order. In nature, there is a Creator who has created the most charming scenery. Believers recognize this Creator and call Him Allaah or God. He is not a man, because no man can create another man. He is not an animal, or a plant. He is not an idol or a statue because these things cannot create themselves or anything else. Neither is He the Sun or the Moon or a machine or a star, but the Maker and Keeper of all. The Maker of anything is greater than the thing He has created. The more complex a thing is, the more complex it’s Creator.
The Holy Quran says )what means(:“Ask of them: 'Who is the Sustainer of the heavens and the earth?' If they hesitate, say: 'Allaah'. Then ask: 'Then why do you take for protectors, instead of Him, other deities who have no power to benefit or avert harm from themselves?' Say: 'Are the blind equal to those who see?' Or do they assign to Allaah partners who have created anything as He has created, so that the creation seemed to them similar? Say: 'Allaah is the Creator of all things. He is the One, the Almighty".]Quran 13: 16[
What is the true nature of the Creator? He certainly cannot be like the created things, for then He would be limited and corruptible like them. Only a Being possessing Absolute Knowledge, Power and Authority and the ability to keep Himself eternally alive, can give life and sustain life and be the Creator of the Universe and its creatures.
The question that now arises is: "Could there be more than one Absolute Creator?" If, for instance, there were two creators and they disagreed over the creation of something, then, either one would have to overcome the other, in which case the defeated one would not have been absolutely powerful. Or they would neutralize each other, in which case both would have been limited in power. Even if we assume they both agreed on everything, still they could not both be absolutely powerful, because the action of one would then depend on the condition that the other does not interfere.
Once again, the Quran tells us )what means(:"He to Whom the Dominion over the heavens and the earth belongs, has begotten no son and has no partner in his kingdom, for it is He who creates everything and determines its nature in accordance with His own design. And yet some choose to worship, instead of Him, imaginary deities that cannot create anything but are themselves created, which can neither avert harm nor help even themselves, and which have no power over life or death nor power to resurrect.”]Quran 25: 2-3[
The Oneness of Allaah is the foundation of belief. Islam rests upon Tawheed: "Laa ilaaha illallaah" -- there is None worthy of worship except Allaah, none worthy of praise, there is no god except Him, no one. Throughout the Quran, the refrain runs on and on: laa ilaaha illaa Allaah, laa ilaaha illaa huwa, Allaahu laa ilaaha illa huwa, Allaahu ahad…which means that Allaah is One, the only One.
Islam is the religion in which the first deadly sin is fabricating partners unto God. It is the only sin that will not be forgiven. The Quran reiterates, not once but twice in the same chapter )what means(:“Allaah forgives not that partners should be set up with Him; but He forgives anything else to whom he pleases; to set up partners with Allaah is to devise a sin most heinous indeed."]Quran 4: 48, 116[ |

Welcome to Islam, - The fossil record refutes evolution

| Contrary to evolutionists' expectations, fossil records provide proof of Creation, not evolution of species
According to the theory of evolution, every living species has sprung from a predecessor. A previously-existing species turned into 'something else' with time and all species have come into being in this way. According the theory, this transformation proceeds gradually over millions of years. If this was the case, then numerous intermediary species should have existed and lived within this long transformation period.
For instance, some half-fish/half-reptiles should have lived in the past, which had acquired some reptilian traits in addition to the fish traits they already had. Or there should have existed some reptile-birds, which acquired some bird traits in addition to the reptilian traits they are believed to have had in the past, as “transitional forms.”
If such animals had really existed, there should be millions and even billions of them in number and variety. More importantly, the remains of these strange creatures should be present in fossil records. The number of these transitional forms should have been even greater than the present animal species and their remains should be found all over the world. InThe Origin of Species,Darwinexplained:
"If my theory be true, numberless intermediate varieties, linking most closely all of the species of the same group together must assuredly have existed.. Consequently evidence of their former existence could be found only amongst fossil remains."
Even Darwin himself was aware of the absence of such transitional forms. It was his hope that they would be found in the future. Despite his hopefulness, he realised that the biggest stumbling-block in his theory was the missing transitional forms. Therefore in his bookThe Origin of Specieshe wrote the following in the chapter “Difficulties of the Theory”:
" …Why, if species have descended from other species by fine gradations, do we everywhere see innumerable transitional forms? Why is not all nature in confusion, instead of the species being, as we see them, well defined?… But, as by this theory innumerable transitional form must have existed, why do we not find them embedded in countless numbers in the crust to the earth?… But in the intermediate region, having intermediate conditions of life, why do we not now find closely-linking intermediate varieties? This difficulty for a long time quite confounded me.”
The single explanationDarwincould come up with to counter this objection was the argument that the fossil record uncovered so far was inadequate. He asserted that when the fossil record had been studied in detail, the missing links would be found.
Believing inDarwin’s prophecy, evolutionists have been searching for fossils and digging for missing links since the middle of the 19thcentury CE, all over the world. Despite their best efforts, no transitional forms have yet been uncovered. All the fossils unearthed in excavations showed that contrary to the beliefs of evolutionists, life appeared on earth all of a sudden and fully-formed. In their enthusiastic efforts to prove their theory, evolutionists have instead unwittingly caused it to collapse.
A famous British paleontologist, Derek V. Ager, admits this fact even though he is an evolutionist:
"The point emerges that if we examine the fossil record in detail, whether at the level of orders or of species, we find – over and over again – not gradual evolution, but the sudden explosion of one group at the expense of another."
Another evolutionist paleontologist Mark Czarnecki comments as follows:
"A major problem in providing the theory has been the fossil record; the imprints of vanished species preserved in the Earth’s geological formations. This record has never revealed traces ofDarwin’s hypothetical intermediate variants – instead species appear and disappear abruptly, and this anomaly has fueled the creationist argument that each species was created by God."
They have also had to deal with the futility of waiting for “missing” transitional forms to appear in the future, as explained by a professor of paleontology fromGlasgowUniversity, T. Neville George:
"There is no need to apologise any longer for the poverty of the fossil record. In some ways, it has become almost unmanageably rich and discovery is outpacing integration…The fossil record nevertheless continues to be composed mainly of gaps. "
Life emerged on earth suddenly and in complex forms
When terrestrial strata and fossil records are examined, it is seen that all living organisms appeared simultaneously. The oldest stratum of the earth in which fossils of living creatures have been found is that of the Cambrian, which has an estimated age of 500-550 million years.
Living creatures found in the strata belonging to the Cambrian period emerged all of a sudden in the fossil record -- there are no pre-existing ancestors. The fossils found in the Cambrian rocks belonged to snails, trilobites, sponges, earthworms, jellyfish, sea hedgehogs and other complex invertebrates. This wide mosaic of living organisms made up of such a great number of complex creatures emerged so suddenly, that this miraculous event is referred to as the “Cambrian Explosion” in geological literature.
Most of the life forms found in these strata have complex systems like eyes, gills, circulatory system and advanced physiological structures no different from their modern counterparts. For instance, the double-lensed, combined eye structure of trilobites is a wonder of design. David Raup, a professor of geology at Harvard, Rochester andChicagoUniversities says: “The trilobites used an optimal design which would require a well trained and imaginative optical engineer to develop today”.
These complex invertebrates emerged suddenly and completely without having any link or any transitional form between them and the unicellular organisms, which were the only life forms on earth prior to them.
Richard Monastersky, the editor ofEarth Sciences, one of the popular publications of evolutionist literature, states the following about the “Cambrian Explosion” which came as a total surprise to evolutionists:
"A half-billion years ago, the remarkably complex forms of animals we see today suddenly appeared. This moment, right at the start of Earth’s Cambrian Period, some 550 million years ago, marks the evolutionary explosion that filled the seas with the world’s first complex creatures. The large animal phyla of today were present already in the early Cambrian and they were as distinct from each other as they are today."
How did the earth come to overflow with such a great number of animal species all of a sudden? How could these distinct types of species with no common ancestors emerge? These are questions that remain unanswered by evolutionists. TheOxfordzoologist Richard Dawkins, one of the foremost advocates of evolutionist thought in the world, comments on this reality that invalidates the very roots of all the arguments he has been defending:
"For example the Cambrian strata of rocks, vintage about 600 million years, are the oldest ones in which we find most of the major invertebrate groups. And we find many of them already in an advanced state of evolution, the very first time they appear. It is as though they were just planted there, without any evolutionary history. Needless to say, this appearance of sudden planting has delighted creationists."
As Dawkins is forced to acknowledge, the Cambrian Explosion is strong evidence for creation, because creation is the only way to explain the fully-formed emergence of life on earth. Douglas Futuyma, a prominent evolutionist biologist admits this fact and states: “Organisms either appeared on the earth fully developed or they did not. If they did not, they must have developed from pre-existing species by some process of modification. If they did appear in a fully developed state, they must indeed have been created by some omnipotent intelligence.”
Darwin himself recognized the possibility of this when he wrote: “If numerous species, belonging to the same genera of families, have really started into life all at once, the fact would be fatal to the theory of descent with slow modification.”
The Cambrian Period is nothing more or less thanDarwin’s “fatal stroke”. This is why the Swiss evolutionist and paleoanthropologist Stefan Bengston confesses to the lack of transitional links while he describes the Cambrian Period and says: “Baffling )and embarrassing( to Darwin, this event still dazzles us.''
As may be seen, the fossil record indicates that living things did not evolve from primitive to advanced forms, but instead emerged all of a sudden and in a perfect state. In short, living beings did not come into existence by evolution, they were created. |

Dought & clear, - Soorat al-Mulk offers protection from the punishment in the graveif one persists in reciting it by night and day, but the night is more certain

| It is said that reading Soorat al-Mulk at night protects a person from the punishment of the grave. Can that be achieved if one recites it by day? Will it save us from the punishment of the grave even if we read it by day?
Praise be to Allah
Soorat al-Mulk is one of the great soorahs of the Qur’an which we are encouraged in saheeh reports to recite frequently, and there are reports which say that it will protect the one who recites it from the punishment of the grave.
Abu Dawood (1400) and al-Tirmidhi (2891 – and he classed it as hasan) narrated from Abu Hurayrah that the Prophet (blessings and peace of Allah be upon him) said: “There is a soorah of the Qur’an, with thirty verses, that interceded for a man until he was forgiven; it is‘Soorah Tabaarak Alladhi bi yadihi’l-mulk (Blessed is He in Whose Hand is the dominion)’ [al-Mulk 67:1].” It was also classed as hasan by al-Albaani inSaheeh at-Tirmidhi.
Al-Mannaawi (may Allah have mercy on him) said:
He recited it frequently, thus it kept asking Allah (to forgive him) until he was forgiven. This is encouragement to everyone to recite it regularly so as to attain its intercession.
End quote fromFayd al-Qadeer, 2/574
Shaykh ‘Abd al-Muhsin al-‘Abbaad (may Allah preserve him) said:
This hadeeth highlights its virtue and tells us that it will intercede on the Day of Resurrection for its companion, i.e., the one who recites it.
End quote fromSharh Sunan Abi Dawood, 8/7.
In the virtue mentioned, that this soorah will intercede for the one who recites it, there is nothing to limit recitation thereof to night or day; rather what may be understood from this hadeeth is that what is meant by reciting this soorah is paying particular attention to it, memorizing it, understanding it, and reciting it frequently, especially in prayer.
With regard to the report narrated by an-Nasaa’i inas-Sunan al-Kubra(10547) and in‘Aml al-Yawm wa’l-Laylah(711), and by Abu Taahir al-Mukhliss inal-Mukhlisiyyaat(228), via ‘Arfajah ibn ‘Abd al-Waahid from ‘Aasim ibn Abi’n-Nujood from Zirr from ‘Abdullah ibn Mas‘ood, who said: “Whoever recitesSoorah Tabaarak Alladhi bi yadihi’l-mulk (Blessed is He in Whose Hand is the dominion) [al-Mulk 67:1]every night, Allah will protect him thereby from the punishment of the grave”, and at the time of the Messenger of Allah (blessings and peace of Allah be upon him) we used to call it al-maani‘ah (that which protects), and that in the Book of Allah there is a soorah, everyone who recites it every night has done a great deal and has done well –
– its isnaad is layyin (weak). ‘Arfajah ibn ‘Abd al-Waahid is dubious, and no one regarded him as trustworthy. Al-Haafiz said inat-Taqreeb(389): He is acceptable, i.e., if there is any corroborating evidence, otherwise his hadeeth is layyin – as was stated in the introduction.
There is no corroborating evidence for ‘Arfajah’s version of this report with these additions. Rather he was contradicted by someone who is far more trustworthy than him, namely Sufyaan ath-Thawri. Al-Haakim (3839) narrated via Ibn al-Mubaarak, and at-Tabaraani narrated inal-Kabeervia ‘Abd ar-Razzaaq (8651), both from Sufyaan, from ‘Aasim, from Zirr, from Ibn Mas‘ood (may Allah be pleased with him) that he said: “(Angels) will come to a man in his grave; they will come to his feet and his feet will say: You have no power over us; he used to recite Soorat al-Mulk. Then they will come to his chest or his stomach and it will say: You have no power over me; he used to recite Soorat al-Mulk. Then they will come to his head and it will say: You have no power over me; he used to recite Soorat al-Mulk. So it is the maani‘ah (protector) that protects against the punishment of the grave and it is referred to in the Torah as Soorat al-Mulk, whoever recites it by night has done a great deal and has done well.
This is the correct report and it is what is known to the scholars. The words “Whoever recites it every night, Allah will protect him thereby from the punishment of the grave”, which appear in the hadeeth of ‘Arfajah, are not known to the scholars, and attribution thereof to the Prophet (sa) is also not known to them. What is correct with regard to the isnaad is that it is mawqoof (ends with the Sahaabi), as in this report of Sufyaan.
It was also narrated by Abu’sh-Shaykh inTabaqaat al-Asbahaaniyyeen(264) in a shorter, marfoo‘ report from Ibn Mas‘ood, as follows: “Soorah Tabaarak (al-Mulk) is that which protects against the punishment of the grave.” It was narrated via Abu Ahmad az-Zubayri from Sufyaan.
Concerning Abu Ahmad az-Zubayri, Ahmad said: He made many mistakes in the hadeeth he narrated from Sufyaan. Abu Haatim said: He was a devoted worshipper and had good knowledge of hadeeth, but he made mistakes.
Tahdheeb at-Tahdheeb, 9/228
This is one of his mistakes when narrating from Sufyaan (may Allah have mercy on him). The correct report is the mawqoof report, as quoted above from Ibn al-Mubaarak and ‘Abd ar-Razzaaq.
Something similar may be said if it is deemed to be marfoo‘ (attributed to the Prophet (sa) via a complete isnaad), as was stated by more than one of the scholars. And this is in harmony with what is stated above. The hadeeth is general in meaning and it is not stipulated that it should be recited at night.
Al-Mannaawi said inat-Tayseer(2/62):
The soorah will give protection to the one who recited it; when he dies and is placed in his grave, he will not be punished there.
Abu’l-Hasan al-Mubaarakfoori (may Allah have mercy on him) said:
What is meant is that reciting this soorah in this world will be a means of salvation from the punishment of the grave.
End quote fromMar‘aat al-Mafaateeh, 7/231
According to the hadeeth of Jaabir (may Allah be pleased with him), the Prophet (blessings and peace of Allah be upon him) did not sleep until he recitedAlif-Laam-Meem tanzeel(Soorat as-Sajdah) andTabaarak alladhi bi yahihi al-mulk(Soorat al-Mulk).
Narrated by at-Tirmidhi (2892) and others; classed as saheeh by Shaykh al-Albaani (may Allah have mercy on him). However it appears to be ma‘lool (problematic), as was stated by Ibn Abi Haatim, narrating from his father, inal-‘Ilal, 1668, and‘Ilal ad-Daaraqutni, 13/340. al-Haafiz Ibn Hajar (may Allah have mercy on him) agreed with him, as it says inIthaaf al-Mahrah, 3/155. He also said, after discussing its isnaad: Based on that, it is mursal or mu‘dal (i.e., not sound). End quote fromNataa’ij al-Afkaar, 3/267
To sum up:
There is the hope that the one who recites this soorah will attain this great virtue and it will intercede for him before Allah and save him from the punishment of the grave. There are reports which speak in particular about giving extra attention to it at night or when going to sleep. So if a person strives to do that, it is a good thing, in sha Allah.

Dought & clear, - Can he give his zakaah to his relative who is studying in university and cannot afford the expenses?

| Is it permissible to give zakaah to a relative of mine who is studying in university far away from his home, because the fees at the nearest university are too expensive and more than he can afford. Please note that he is working to support himself, and he has siblings who it seems cannot help him.
Praise be to Allah
It is permissible to give zakaah to relatives who are entitled to it; that is better than giving it to people who are not your relatives, because charity that is given to a relative is both charity and upholding ties of kinship. The Prophet (blessings and peace of Allah be upon him) said: “Charity given to a poor person is charity, but that which is given to a relative is two things, charity and upholding ties of kinship.”
Narrated by an-Nasaa’i, 2581; at-Tirmidhi, 658; classed as saheeh by al-Albaani inSaheehan-Nasaa’i, 2420.
But that is subject to two conditions:
1.
That the relative who receives the zakaah should be one who is entitled to it (poor or needy), even if he has a job, so long as his earnings are not sufficient to meet his needs.
Moreover, it makes no difference whether the university is near or far; rather what matters is whether the man is poor or needy.
2.
That these relatives should not be among those on whose maintenance it is obligatory for the zakaah-giver to spend. If spending on their maintenance is obligatory for him, then it is not permissible for him to give them anything from the zakaah on his wealth.
Ash-Shaafa‘i said inal-Umm(2/87): He should not give (the zakaah of his wealth) to his father, mother, grandfather or grandmother. End quote.
Ibn Qudaamah said inal-Mughni(2/509): Obligatory charity (i.e., zakaah) should not be given to parents or grandparents, no matter how far the line of ascent reaches, or to children or grandchildren, no matter how far the line of descent reaches.
If these two conditions apply with regard to this relative of yours, it is permissible to give him enough to meet his needs from the zakaah of your wealth. One of those needs is to complete his studies, so long as it is a permissible field of studies that is beneficial in religious or worldly terms. Al-Mirdaawi said inal-Insaaf(3/218): Shaykh Taqiy ad-Deen favoured the view that it is permissible to accept zakaah in order to buy books that he needs, books of knowledge that are essential to his religious and worldly interests. End quote. And this is the correct view.

Dought & clear, - Sunnah prayer for one who misses Fajr prayer in congregation

| If a Muslim misses Fajr prayer in congregation because he was asleep or for some other reason, when should he offer the two rak‘ahs of Sunnah prayer, is it before or after praying Fajr?
Praise be to Allah
If a person misses Fajr prayer in congregation and did not catch up with it, then he should start with the Sunnah prayer and offer that first, then pray Fajr. When the Prophet (sa) slept one night and missed Fajr prayer whilst travelling, and nothing woke him up except the heat of the sun, he offered the Sunnah prayer then he prayed Fajr, and he gave instructions that the adhaan and iqaamah should be given as was usual. So if a person misses Fajr prayer and does not wake up until after the people have prayed, or he comes to the mosque and finds that the people have already prayed, then he should offered the Sunnah prayer of two rak‘ahs, then pray Fajr. This is the Sunnah.
But if he delays it until after the prayer or after the sun has risen, there is nothing wrong with that. But it is preferable to start with it, as the Prophet (blessings and peace of Allah be upon him) did when he missed the prayer on one of his journeys.
If he comes to the congregation and finds them already praying and he prays with them without having offered the Sunnah prayer first, he may offer it after the (obligatory) prayer, to make it up, or he may offer it after the sun has risen and become high, which is preferable. Both options are mentioned in the hadeeth, and he has the choice, in sha Allah: he may offer it after Fajr, in the mosque or at home, or if he wishes he may offer it after the sun has risen and become high. The matter is broad in scope, praise be to Allah, and both are mentioned in hadeeths from the Prophet (blessings and peace of Allah be upon him). |

Once, the people of the city invited Mulla Nasruddin to deliver a speech. When he got on the pulpit (Minbar), he found the audience was not very enthusiastic, so he asked: "Do you know what I am going to say?" The audience replied "NO", so he announced: "I have no desire to speak to people who don't even know what I will be talking about" and he left.
The people felt embarrassed and called him back again the next day. This time when he asked the same question, the people replied "YES", So Mulla Nasruddin said, "Well, since you already know what I am going to say, I won't waste any more of your time" and he left.
Now the people were really perplexed. They decided to try one more time and once again invited the Mulla to speak the following week. Once again he asked the same question - "Do you know what I am going to say?" Now the people were prepared and so half of them answered "YES" while the other half replied "NO". So Mulla Nasruddin said: "The half who know what I am going to say, tell it to the other half" and he left! |

Fathwa, - Gallstone Removal and the Ability to Fast

I have suffered from gallstones for twenty years and then had them removed a few months ago. Will I be able to fast like normal people?
Answer:
Assalaamu ‘Alaykum, honorable sister.
You have not mentioned in your question where exactly this gallstone was in your body so that we may properly answer you. However, regardless of where it was, if it did not affect the function of any of your organs, or result in a malfunction in any of them, and you do not suffer any other sickness which may affect your health when fasting, then we do not see any reason why you cannot fast. |

After two and a half years of marriage, Allaah has blessed me to become pregnant. I am now in my fifth month and have just discovered that I have twins in the same embryo sac and that they share one placenta. They are both healthy now, but the doctor told me that there is a high risk of malformation, damage, or death to both, or at least to one, of them. There is another risk facing them, which is that the umbilical cord of one of them might wrap around the neck of the other one and thus result in his death. The doctor is suggesting that I stay in the hospital when my thirtieth week starts and that she should deliver at the thirty second week. Is all she is telling me true? Here in the States, we fast from 5 am till 4:30 pm; will fasting affect my health or that of my twins?
Answer:
Assalaamu ‘Alaykum, dear sister.
There are two types of twin pregnancy:
1.Both fetuses in one embryo sac, and
2.Each fetus in its separate embryo sac.
If both fetuses happen to be in the same sac, then there is a possible problem, as your doctor told you. It is usually recommended in such cases to deliver the mother by a C-section operation to avoid any complications. The doctor monitoring your case is the one who can best judge when to do the operation, but it is usually after the end of the thirtieth week of pregnancy. The doctor can judge by periodic examination and ultrasound, and if there is an indication of any problem, then the operation can be done earlier. However, if things go smoothly and everything looks normal throughout the periodic examination, then the operation can be delayed till week 35 or 36, to give the fetus enough time to grow normally inside the womb. If there is a need to run the operation early, then the mother can take Dexamethasone, which helps in the development of the respiratory system of the fetus.
As for fasting, Islam is a religion that gives exemptions at the time of need and never overburdens people with what they cannot handle. If you find it difficult to fast while pregnant and you fear for yourself or your fetus, then you may break your fast and make up these days later. |

Fathwa, - Excessive Phlegm While Fasting

Answer:
Assalaamu ‘Alaykum, respected sister.
This could be a result of a problem in your respiratory system, such as a chronic infection that may be in your windpipe, throat or nasal sinuses. Furthermore, allergies in the upper respiratory system could cause such a problem.
Some people who suffer from reflux, which is backflow of food from the stomach to the esophagus, face this problem )along with other symptoms(. A chronic stomach ailment may also be the cause of such a problem.
You must know what exactly is causing the problem in order to be able to treat it and take proper medication for it. Therefore, we advise you to consult a physician to determine which of the above is the underlying cause of your problem. |

What to see
Venice-like, the shady streets of Alappuzha (Alleppey) are set around a grid of canals that spill into the watery highways of Kerala. As the gateway to the backwaters, this is the place to soak up village life before taking a trip on a houseboat. Lakes & Lagoonsoffers gorgeous accommodation on traditional rice boats.
With guesthouses and restaurants perched perilously along a cliff edge, Varkala is a sight to behold. It’s also more laid-back than Kerala’s other beach resort, Kovalam.

| A Swiss university conducted a recent study on the health benefits of marriage.
The study proved that marriage protects men and women from chronic and occasional headaches. The psychological feeling of a lasting and stable relationship helps to reduce physical stress and increases the excretion of the happiness hormone in larger quantities than those of worry, fear and sadness.
The study also proved that early marriage helps man to get rid of most forms of psychological and nervous pressure, as well as the consequences of work problems and confrontation with society. Marriage also helps in treating insomnia and insufficient sleep in addition to getting rid of extra calories with no less than 200 calories burned during each sexual intercourse. This equals exercising for 40 minutes for men. Marriage also helps men retain their vitality for many years and decreases the possibility of their being afflicted with prostate cancer by no less than 85%. Moreover, the study asserted that marriage strengthens the heart muscles, activates blood circulation, and helps inhaling additional oxygen, which benefits the body and gives it more energy.
One of the most important findings of this study, which is based on a sample of 5,000 married men and women, is that marriage helps one enjoy intellectual, emotional and physical stability, and that if marriage lacked any of these elements, it would lead to dire consequences for the life of the husband and the wife.
All the 5,000 spouses who were included in this study asserted that their current life is much better than their life before marriage. They all affirmed that the presence of children in their life creates a happy marital relationship and understanding and helps them preserve the entity of the family.
The study mentioned that misunderstanding, insincerity, niggardliness and dominance are the most important things about which married people are concerned. On the other hand, love, understanding, sincerity, truthfulness, caring for the interests of each other and performing marital duties perfectly were proved to be among the factors that bring the spouses closer to each other.
The study concluded its results by saying, “It is not difficult to get married, but it is also not easy to be continually happy as a spouse.” |

| Without a set of rules and orders to be applied and respected, life would be chaotic and uncivilized. A home that is based on desires will be destroyed by them. A home that is built on water will sink into it. A house that is constructed in the path of the flood will be destroyed by that flood. A family that is founded on piety and obedience to Allaah The Almighty cannot be uprooted, even by the strongest of winds.
“Build your house on rock” is the advice of many grandfathers to their grandsons. What a wonderful order it is when it is followed at home, at school, in the factory, in the mosque and on the street. Conversely, how great is the ugliness of chaos at home, at school, at the clubs and on the street. One of the great tasks that Allaah The Almighty assigned to His Messengers was to teach people good manners. Some people call virtues and good manners etiquettes. Anyone who observes these rules is regarded as being civilized and well-mannered. On the other hand, anyone who violates these rules is considered uncivilized and ill-mannered.
We usually observe manners around strangers, so that we would gain their trust, respect and appreciation. However, often when we are around our loved ones who live with us or our life partners, we act thoughtlessly. We might hurt their feelings unintentionally and sometimes even intentionally hurt them because we think that etiquettes should be observed only while dealing with strangers. When dealing with close ones, we are often rough, thoughtless, and uncouth. Therefore, every newly-wed couple should agree together on rules to be written in the form of a document or an agreement that includes everything that can enrich their life and provide it with pleasure through activities, various hobbies, visits, meditations, and journeys. The purpose of this agreement is to enhance the spouse’s respect and appreciation for each other, and to decrease the amount of disagreements and maltreatment.
They should agree on a penalty that will befall either of them who violates any of the terms of the agreement. Penalties can include desertion for no more than a day or two, an apology to the wronged spouse, paying an amount of money or to buy a gift to make it up to the wronged spouse. Then, both parties should willingly sign that document. In the course of time, new terms can be added and old terms may be deleted. However, order should remain in effect and respect should be ongoing.
Some Rules for Good Manners
Some of the good manners that Islam and people with illuminated minds encourage, which some people may call etiquettes, are:
1-To ask permission and knock before entering anyone’s room.
2-To say “Assalaamu ‘alaykum…” when entering the home, the room or the car.
3-The person who is leaving a room should ask those inside the room whether they need anything from outside.
4-A person should not read a letter, a check or a piece of paper that does not belong to him.
5-To return anything, such as a book or a ruler, that we borrow.
6-To buy a new object if we break or damage something belonging to someone else.
7-To put anything which belongs to the other partner back where it was if we move it.
8-To apologize to the person we wrong.
9-To accept the apology of the wrongdoer without blaming excessively.
10-To have quiet, respectful speech that does not have any foul language in it.
11-To speak the truth even if it is bitter but in a gentle, unoffending way.
12-To offer advice to the one who needs it without any haughtiness.
13-To be pleased when our partner is pleased. If one weeps, the other should be sad and weep or at least try to weep.
14-To share in happy occasions and not miss them.
15-To respect, appreciate, and praise the other’s hobbies as if they were ours.
16-Not to return an irritable, rash attitude with a similar one.
17-To help the other fulfill his tasks quickly, if he needs help.
18-Not to make up arguments or reopen closed subjects of disagreement so as not to renew pain and sorrow.
19-Tolerance and forgiveness are some of the noblest attributes.
20-To distribute the tasks between both parties. Everyone should fulfill their duty before demanding their rights.
21-Never lie; no matter how big the mistake we try to hide is. Lying is the father of all sins and a liar will not enter Paradise.
22-If the spouses see an incident together and one of them narrates it to others differently from how his/her spouse sees it, the other spouse must not comment or belie them; let him/ her complete the story the way they see it.
23-Never steal no matter how badly money is needed.
24-To love for the spouse what one loves to himself/herself and try to comfort him/her as much as possible.
25-Maintaining patience in times of adversity is an act of worship. Frequent praising of Allaah The Almighty is obligatory.
26-Salaah)Prayer( is the pillar of the religion, and confidence in Allaah The Almighty is the basis of success and certainty.
27-Everyone should call their partner by the name they like and not to take liberties in dialogue or joking in private or among others. |

Marital Life, - Before it is Too Late

| It was completely unpredictable that something was going to happen and that my young, gentle cousin would experience the most difficult trial or that her two young children would become orphans in less than a moment.
As usual, her husband dined and performed the ‘Ishaa’prayer at home after a long, exhausting day at work. As he folded the rug on which he performed the prayer, he said to her, "May Allaah forgive me. I was occupied with work and did not pray at the mosque today." She carried the dishes of food and went to the kitchen. Before she had put them in the sink, she heard a bang and a crashing on the floor. She ran to find her husband lying motionless on the floor. Minutes later, the doctor arrived, turned his hands and sadly announced her husband's demise.
A few days earlier, l had offered condolences to my friend at the death of her husband who fell on the floor of the bathroom while he was performing ablution. He left behind two children; the older is three years old and the other is a newborn. Less than one month later, my husband prayed the funeral prayer over his neighbor whom he had met and greeted on the staircase that morning as the two were going to work. After every consolation, the question that emerged was regarding the last words that the husband said to his wife before he died. Was he pleased with her or not? I was astonished with myself and spoke to my husband about this. He smiled, and said, "Press inquisitiveness." Actually, it was not mere inquisitiveness; my questions were accompanied by intense fear and worry as well as intense certainty. I realized why the Prophet,sallallaahu ‘alayhi wa sallam, warned wives against letting the night pass while her husband is angry with her, and why he gave the glad tidings of Paradise for any woman who dies while her husband is pleased with her.
I was terrified at the thought that a disagreement could arise between me and my husband and we would have a row, then he would go to bed, draw the cover over his head, sleep, and never wake up again. It would be impossible for me to make up with him and see a pleased smile of forgiveness on his lips and a look of tolerance in his eye. I did not ask any widow the questions that I had. I kept my concerns within myself and sought refuge with Allaah The Almighty from interfering in other people’s affairs. Since that time, a strange change took place in my life. When my husband goes to bed while I am busy with some housework, I leave the work and go to his bed in order to watch his breath and be certain that it is regular. When he delays a little after the usual time of coming home from work, I sit there trembling behind the door of the apartment as if I am waiting for someone who will tell me what I do not want to hear.
It has become the favorite jest of my husband when I talk to him, to put his hand on my mouth and imitate me saying: "Sweetheart, are you pleased with me," then he bursts into laughter. I have come to ask him this repeatedly after my shock to see the sudden death of three healthy husbands within just one month. The only good thing about these sad feelings is that they alerted me to the wisdom and eloquence of the Prophet,sallallaahu ‘alayhi wa sallam, and made me keener to please my husband. They purified me from the remains of arrogance that sometimes caused me to think that I was not guilty when I really wronged him; and prevented me from thinking that he might die while being angry with me. It has become easy for me to apologize even though I used to find that was difficult for me to do. It has become my pleasure to please my husband after it was just a duty. My husband's waking up and peacefully returning home after work have become the happiest moments of my life after they used to be usual routine. I used to be indifferent to those moments as if I was saying, "It is a routine that he wakes up. It is ordinary routine that he returns home after work." His voice has become more lovable to my ears. When I tidy his study, prepare his food or arrange his clothes, I supplicate to Allaah The Almighty not to deprive me of this beautiful effort, the wonderful effort which indicates that my husband is still with me and that he is alive.
I did not want to keep such feelings to myself, I believe that it is a trust and responsibility to transfer it to each wife. How wonderful it is for a wife to go to sleep while her husband is pleased and content with her. If he dies during that night, it would relieve a little of her sadness to know that he was pleased with her. How wonderful it is for the wife to know that her husband was not angry with her or annoyed at some of her behavior when he died. Each Muslim wife, who knows the correct way, should expect the death of her husband at any moment and, therefore, she should not surrender to the feelings of fear and ask herself, "What will I do without him?" She has to love him more and do her best to fill him with feelings of satisfaction and happiness. She has to minimize their disputes, cherish the moments of affection and serenity and not allow them to pass. She has to do only what brings his satisfaction and avoid everything that displeases him.
Many wives are miserable with their husbands and because of them. This really happens. They may be unable to do anything but wish that death would separate them. However, I am sure that they would regret this when the wish is realized, long for the days of their life together and repeat in a sad voice an Arabic proverb that I have recently understood the wisdom of, "His cruelty is better than the emptiness of his place at home."
Moreover, I realized how hasty I was when I harbored enmity towards their saying, "The mere shade of a man is better than the shade of a wall," and considered it a disgraceful proverb that mocked women. The shade of the wall does not provide feelings of security, cordiality nor remove the loss of feelings of loneliness and silence. The shade of a wall is not a being that a woman can belong to or be a member in a family with. Without her husband, a woman is hanging in space. The shade of a man is the shade of a partner, even if he is a contradicting partner. Only a foolish woman wastes the privilege of having a husband and fails to protect herself with him from the coldness of loneliness and the bitterness of regret when it is too late. |

Dought & clear, - Why is the legacy mentioned first in the aayah, “after payment of legacies that you may have bequeathed or debts” [al-Nisa’ 4:12]?.

| Why is the word wasiyah (legacy, will, bequest) mentioned in the Qur’an before the word dayn (debt?) when we know that the debt must be paid off before the legacy is given?
Praise be to Allaah.
Al-Qurtubi (may Allaah have mercy on him) said: “What is the reason why the legacy is mentioned before the debt, when the debt takes precedence according to scholarly consensus, i.e., the debts of the deceased must be paid off from his estate before his will is executed… this may be answered in five ways:
1 – What is meant is that these two issues take precedence over the issue of inheritance, and the order in which they are mentioned is not indicative of which one is more important. Hence the bequest was mentioned first.
2 – Because the legacy is less binding than debt, it is mentioned first to show that it is nevertheless important, as when Allaah says (interpretation of the meaning):
“What sort of Book is this that leaves neither a small thing nor a big thing…”
[al-Kahf 18:49]

4 – The legacy is mentioned first because it is the share of the poor and needy, and the debt is mentioned second because it is the share of the lender who can seek it with force and who has a strong argument to support his case.
5 – Because the legacy is something that is initiated by the person, it is mentioned first, whereas the debt is something that is well established and clear whether he mentioned it or not.
Seeal-Jaami’ li Ahkaam al-Qur’aanby al-Qurtubi, vol. 5, p. 74.
Some scholars added two extra points:
“The legacy is mentioned first because the legacy is an act of kindness and upholding family ties, unlike the debt which usually results from a kind of neglect. So the phrase starts with the legacy because it is of greater virtue.
And it was said that the legacy is mentioned first because it is something that is given for nothing in return, whereas the debt is given in return for something. So payment of the legacy is harder for the heirs than payment of the debt, and paying the legacy may be thought of as a form of waste, unlike the debt which the heir will pay with condifence.” |

| What constitutes revitalizing disused land (al-mawaat)? What are the rulings on that?
Praise be to Allaah.
Al-Mawaat is that which has no soul. The meaning here is land which has no owner.
The fuqahaa’ (may Allaah have mercy on them) defined it as land which is not being used for a specific purpose and which is not owned by anyone whose ownership is protected by sharee’ah.
Two things are exempted from this definition:
(1) Land which has come under the protected ownership of a Muslim or a kaafir via purchase, as a gift or any other means.
(2) Land which serves the interests of owners whose ownership of land is protected, such as roads, courtyards and waterways, or lands which serve the interests of city dwellers, such as graveyards, garbage dumps, places designated for Eid prayers, woodlots and pastures. None of these may be acquired by revitalizing the land.
So if the land is not owned by a person whose ownership is protected, and it is not serving a specific purpose, and someone revitalizes it, then he becomes the owner of it, because of the hadeeth of Jaabir which was attributed to the Prophet (peace and blessings of Allaah be upon him): “Whoever revitalizes dead (disused) land, it becomes his.” This was narrated by Ahmad and al-Tirmidhi, who classed it as saheeh. There are other ahaadeeth which are similar in meaning, some of which are narrated inSaheeh al-Bukhaari.
Most of the fuqahaa’ of different regions agreed that possession of disused land may be taken by revitalizing it, although they differed as to the conditions attached to that, except for the disused lands of the Haram (sanctuary of Makkah) and of ‘Arafaat, which cannot be taken possession of by revitalizing them, because that would make it too difficult to perform the rituals and because he would be taking land which may have to be used during the Hajj.
Revitalizing disused land may take several forms:
(1) If a person encloses it with a solid wall to keep others out, of the kind that is usually used for that purpose, then he has revitalized it, because the Prophet (peace and blessings of Allaah be upon him) said: “Whoever encloses land with a wall, it becomes his.” This was narrated by Ahmad and Abu Dawood from Jaabir, and classed as saheeh by al-Jaarood; a similar report was narrated from Samurah. This indicates that enclosing the land is one of the things by which a person earns the right to ownership. What should be borne in mind is what the word haa’it (wall) refers to in linguistic terms; if a person merely places stones, piles of dirt or a small wall around the land which does not keep anyone out, or he digs a ditch around it, then he does not take possession of it, but he will have more right to revitalize it than anyone else, and he is not permitted to sell it unless he revitalizes it.
(2) If he digs a well on the disused land and reaches water, then he has revitalized it. If he digs a well but does not reach water, then he does not take possession of the land thereby, but he will have more right to it than others, because he has started to revitalize it.
(3) If he brings water to the disused land from a spring or river, then he has revitalized it thereby, because the water is of more benefit to the land than a wall.
(4) If he drains water from disused land which was covered with water, because of which the land was not suitable for farming, and he drains the water so the land then becomes fit for that use, then he has revitalized it, because this is of more benefit to the land than the wall by building which, according to the report, one takes possession of the land.
Some of the scholars think that revitalizing disused land should not stop there; rather the matter should be referred to ‘urf (custom) and what the people count as revitalizing land, because through this revitalizing process he will become the owner of the land. This was the view of a group of Hanbali imams and others, because sharee’ah made revitalizing the land the condition for taking possession of it, but it did not define precisely what was meant by revitalizing. So we should refer to what is regarded as revitalizing land according to custom.
The Muslim ruler has the right to give land to one who will revitalize it, because the Prophet (peace and blessings of Allaah be upon him) gave land to Bilaal ibn al-Haarith al-‘Aqeeq, he gave land in Hadramawt to Waa’il ibn Hajr; and he gave land to ‘Umar, ‘Uthmaan and a number of the Sahaabah. But the recipient does not become the owner of the land just because he has been given it, unless he revitalizes it, but he has more right to it than others, so if he revitalizes it, it becomes his, and if he is unable to revitalize it, the ruler can take it back and give it to someone else who is able to revitalize it. ‘Umar ibn al-Khattaab (may Allaah be pleased with him) took back land from those who were unable to revitalize it.
Whoever reaches a permissible thing first – apart from disused land – such as game [animals or birds for hunting] or wood, then he has more right to it.
If water that is permissible for everybody (i.e., water that is not owned by anybody) passes through people’s lands, such as a river or the water of a wadi, then the owner of the higher land has the right to use the water for irrigation and to withhold it until it reaches the ankles, then he should let it flow to people further on, and so on in turn. The Prophet (peace and blessings of Allaah be upon him) said, “Irrigate (your land), O Zubayr, then withhold the water until it reaches the walls between the pits round the trees” (agreed upon). ‘Abd al-Razzaaq quoted Mu’ammar al-Zuhri as saying, “We looked at the words of the Prophet (peace and blessings of Allaah be upon him), ‘then withhold the water until it reaches the walls between the pits round the trees,’ and it came up to the ankles.” In other words, they worked it out from the story and found that it came up to the ankles, so they made that the standard for deciding how much the first one should take, then the next one, and so on. Abu Dawood and others narrated from ‘Amr ibn Shu’ayb that the Prophet (peace and blessings of Allaah be upon him) ruled concerning the waterway of Mazoor (a well known wadi in Madeenah) that the (owner of the) higher (land) should withhold the water until it reached the ankles, then the (owner of the) higher (land) should let it flow to the lower (land).
But if the water is owned, it should be divided among the owners based on the size of their land, and each of them may dispose of his share as he wishes.
The leader of the Muslims has the right to protect the grazing lands of the flocks belonging to the Bayt al-Maal (treasury) of the Muslims, such as horses used for jihad and camels given in charity, so long as that will not harm the people by making things difficult for them. Ibn ‘Umar (may Allaah be pleased with him) narrated that the Prophet (peace and blessings of Allaah be upon him) protected (the land of) al-Naqee’ for the horses of the Muslims. It is permissible for the ruler to protect the grass of disused lands for the camels given in charity, the horses of the mujaahideen, the cattle given as jizyah (tax paid by non-Muslim subjects of the Islamic state) and lost animals, if there is a need for that and if that will not cause hardship to the Muslims. |

These papers on which Allaah’s name is mentioned should be kept and protected against being handled with disrespect until you have finished with them. When you have finished with them and no longer have any need of them, they should be buried in a clean place, or burnt, or kept in a place where they will be protected against disrespect, such as in a cupboard or on shelves, etc. |

General Articles, - Important statements from Al-Barzanji's book Al-Isha'at ul Ishraat us Saa'at'' (Portents of the Judgment Day)



The Great Sheikh has a poem as follows:
Be aware, the end of the saints is a martyr. He is Mahdi the Sayyid (as), who will be a descendant of Ahl al-Ahmad. He is a sharp sword, warding off the evil! He is the sun that will eliminate all the pains and troubles. When he gives, he is like a fruitful rain.
Hazrat Mahdi (as) is a martyr. He is a very select leader. He is a descendant of the Prophet Mohammad (saas). He is the sword of knowledge, a very effective, very sharp sword that will ward off the evil, all pains and troubles, what does pain mean? He will take away all the pains, stresses, tension, pains, and psychological problems of people. He says Hazrat Mahdi (as) is a sun that will destroy all the oppression, torture, threats and ordeals of people. What does Ataturk say? He also says he is a sun. What does Bediuzzaman say? Sun. What does the Prophet Mohammad (saas) say in his hadith? A sun. he will be fruitful just like a rain.
The time has come. He has become apparent in the fourth century after the three centuries that had passed. Because the Prophet Mohammad (saas) talked at once about three centuries, followed by a fourth one. In one account, it is said ‘three centuries follow each other, one apart from others …’.
In other words, three centuries are one after another and another one is alone, which is four. And if you add one thousand? 1400 in Hijri calendar. Because Imam Rabbani says that he will come one thousand years after the demise of the Prophet Mohamed (saas). When you put it together with this report, you get 1400 in Hijri calendar.
As to him; he has authority and power. He will gain the power he needs from Allah. Because he is a verified caliph (spiritual successor) who speaks language of the birds and of all animals. For that reason, his justice will be witnessed by all the humans and jinns.
He will get the power he needs not from people, but from Allah. Because he is a leader whose reliability is confirmed by Allah, and who speaks the language of all birds and animals, as reported in hadith, which means that he will have love for all animals. He will love all of them. The hadith says his justice will extend to the jinns too, which means he will have contact with them. He will ensure justice amongst them too, and prevent them from oppressing each other.
As indicated above, Allah has bestowed him helpers who believe in him. He will make great accomplishments by the help of his aides.
He will accomplish great things by the means of his helpers, so we understand that he has students. The Prophet Mohammad (saas) says Hazrat Mahdi (as) will not be alone.
The qualities required by Hazrat Mahdi (as) for the duties he will assign to his helpers:
1. Prudence; because this quality is needed when people are invited to Allah’s path. As a matter of fact the Almighty Lord has told as follows while telling the stories of the Prophets:, "I call to Allah with inner sight, I and all who follow me.."
Hazrat Mahdi will no doubt follow the Prophet Mohammad (saas). Just like the Prophet Mohammad (saas) didn’t make any mistakes in inviting people to Allah’s way, Hazrat Mahdi (as) will not make a mistake too. Because Hazrat Mahdi (as) will follow in the footsteps of the Prophet Mohammad (saas).
One of the most important qualities of Hazrat Mahdi (as) is that he has prudence. ‘I call to Allah with inner sight, I and all who follow me’, which means ‘I invite people to Allah with my students’. The verse refers to Hazrat Mahdi (as) in that sense. Hazrat Mahdi (as) will be innocent in his decisions.
2. He understands the Holy book perfectly.
He will understand and explain the Qur’an perfectly.
3. He understands the meaning of the Words of Allah.
He will be able to interpret the Qur’an perfectly and explain it to people in an excellent way.
4. He knows perfectly the character and thoughts of the people he will appoint to positions…
Hazrat Mahdi (as) will be able to analyze the situation, mood, attitude, behavior, in other words, the character, psychological state of people very well.
5. He never ceases to be compassionate and just even when he gets angry…
Sometimes Allah will give a sense of great rage in him, but despite that he will never cease to be compassionate and just. He is very compassionate, in other words he is reasonable even when he gets very angry. He thinks reasonably, he acts by the Qur’an and never stops being fair. He always judges fairly even if it is against him. He is not seeking to save himself or protect his own interests.
6. Knows the classes of the beings..
He treats the kids the way they should be treated, and the grownups in the way grownups should be treated. Same thing goes for everyone, the elderly, the women. He treats everyone according to the way they would like to be treated. He knows how to speak to their soul. This is a quality of Hazrat Mahdi (as).
7. He knows about the complex details of the things; because a leader with this information will not make a mistake in his decisions… Hazrat Mahdi (as) knows the knowledge of comparison not for using it in his judgments, but for avoiding it. Because his judgment will be the result of right inspiration. He will act upon the Sunnah of the Prophet Mohammed (saas). For this reason, when the Prophet Mohammad (saas) described him, he said ‘He will follow in my footsteps, he will not make a mistake’. We understand from this that, he will not introduce a new command, but he will follow the existing Sunnah. He will also be innocent. With the phrase ‘innocent’, it is meant he will be innocent in his decisions. Because the real innocence can be possible only for a Prophet. But he is not a Prophet, he is a Saint. The saints are protected from making mistakes, they are not innocent.
He knows the complex details, fine details. He analyses why someone did something, for what reason, he is capable of doing a very detailed analysis.
Because a leader with this knowledge, will never make a mistake; Hazrat Mahdi (as) knows the knowledge of comparison not for using it in his judgments, but for avoiding it too, which means he will not act according to comparison. He avoids comparison, which was used in Islamic canonic law.
The Prophet Mohammad (saas) informs us upon revelation, that he will not make a mistake. He will be innocent in his decisions. When people think he made a mistake, it is still a right decision. Allah doesn’t allow him to make a mistake in his judgments. He is an innocent imam, this is exclusive to Hazrat Mahdi (as) only. He is under the special protection of Allah. The innocent imam. Always right in his decisions. But the real innocence can be seen only in the Prophets, the Prophets are protected in every way.
8. Understanding the needs of people well; because Allah has brought him over other people to take care of them. The actions and decisions of the leaders must be to seek the interests of the people, rather than themselves. A leader that does not work for the interests of the people and help them, must be relieved of duty. Because there is no more any difference between him and the people.
The quality of Hazrat Mahdi (as) is this: whole world is his family. If a kid’s leg is broken in Uganda, he will be taken care of, as if he was the child of Hazrat Mahdi (as). A Muslim in London and a Muslim in Uganda will be treated the same way. Both will eat very good food, will receive very high quality treatment, both will live in very good houses. There will be no more second class citizen, third class citizen. Everyone will be like the child of Hazrat Mahdi (as). For example let’s say a kid in Japan is to be operated on. You know in some communities, no one knows what’s going on in the life of others. It won’t be like that with Hazrat Mahdi (as). Hazrat Mahdi (as) will be as careful as it is his own operation. That’s why he will resist the offers to make him imam. He doesn’t accept, but they force him. Because the spiritual responsibility is too great, because he is responsible for the entire world, he is given the duty of imamate (religious leadership) by force, under the threat for his life. He will not seek his own interests, but he will make sure that the people’s interests are safeguarded in the best way possible. He will follow very carefully. Everyone in the hospital will be a first class citizen. Everyone will eat the best food. Hazrat Mahdi (as) will make sure that everyone will eat what he eats, everyone will wear what he wears, and everyone will live as comfortable as he does. This is the characteristic of Hazrat Mahdi (as). Because there is no more difference between him and other people, they are the same, he takes care of everyone so carefully, it’s like they will all be his own children.
9. He will have the knowledge of the unknown , which will be needed particularly in his time, because only then, can he solve the emerging problems. As indicated above, Hazrat Mahdi (as) will not act on comparison. Because comparison will lead to many new issues, and this will only cause trouble for people. But the preferred action in Islam is facilitation. For this reason, the Prophet Mohammed (saas) said: ‘Leave me alone when I leave matters to you to decide’. In this way he didn’t want people to ask him many questions, in order to prevent too much judgments and offers. He only settled with communicating the message of Allah. So since we understand that Hazrat Mahdi (as) will follow in the tracks of the Prophet Mohammad (saas), he will not make a mistake, and he will be very compassionate to beings just like the Messenger of Allah.
So Hazrat Mahdi (as) will have these nine qualities. He will have knowledge of unseen, which is particularly needed in his own time. He will know what will happen in the future, based on the hadiths and the Qur’an verses. He will take appropriate measures since he will know what will happen in the future, by the leave of Allah.
There will be no more comparison, Hazrat Mahdi (as) doesn’t use comparison. He says that if comparison is used, then there will appear complex judgments and an inextricable understanding of Islam for people. He will not accept that. Because that would trouble the people. Our religion is the religion of ease. It is Allah’s orders to make the religion easier. And making it difficult would be what satan wants. Making the religion, worshipping, life easier, that’s the style in Islam.
"Leave me alone when I leave matters to you to decide’, meaning ‘don’t try to produce new judgments’. When the Companions asked him ‘how will this be?’, he answered ‘do whatever you think is the best, because if I say something, it will be a judgment, and you will have to do it from now on, so don’t ask me, live freely’ said the Prophet Mohammad (saas). ‘If it is something important, I will warn you anyway’ he says. ‘But if I don’t say anything, don’t try to produce judgments and don’t force me to do it’.
So he doesn’t want too many rules and judgments. What is the situation now? There are too many rules and judgments. That is what gave birth to superstitions, innovations, religion turning into something else. This is the real reason behind the pains of the Islamic world.
He confined to communicating the message of Islam. Allah gave him information about significant and critical matters, other than that, Muslims should be left free.
Since Hazrat Mahdi (as) will follow in the tracks of the Prophet Mohammad (saas) and will not make a mistake, then he has to be very compassionate towards the beings just like the Messenger of Allah. So he is not only compassionate, he is extremely compassionate, towards all living things, to dogs, cats, fish, people, kids, all of them…
The Prophet Mohammad (saas) said that Hazrat Mahdi (as) will not make a mistake but was silent about others; in other words, the Prophet Mohammad (saas) didn’t say that other imams like Abu Bakr, Omar, Uthman, Ali and other saints will be innocent. He only said Hazrat Mahdi (as) will not make a mistake, this is firm in the hadiths.
The Prophet Jesus (as), will descend onto a white minaret to the east of Dimashq, in the time of Hazrat Mahdi (as), while people are performing the afternoon prayer. The imam will step back and he will lead the prayer, and he will act as an imam and perform the salat in line with the commands of the Prophet Mohammad (saas).
Some people misinterpret this. Sham is a very wide area. A very vast land that includes Istanbul and Anatolia, is called Sham. So he will appear in a high building, a high house. Because when minaret is said, the first thing that comes to mind is a tall building. A high place, where he can be heard from everywhere.
Warning:
The meaning of this hadith is not contradictory to the hadiths which narrate that the Prophet Jesus (as) will follow Hazrat Mahdi (as) in the morning salat, when he will say ‘this was sent for you!’.
So it is not contradictory with the situation where the Prophet Jesus (as) pushed Hazrat Mahdi (as) forward to make sure that he leads the salat. So the Prophet Jesus (as) makes Hazrat Mahdi (as) the imam and then Hazrat Mahdi (as) makes the Prophet Jesus (as) the vizier. What is related here happens after this prayer. So Hazrat Mahdi’s (as) position as the imam is verified, it is recognized that he is the leader of the world. The Prophet Jesus (as) confirms that he is the imam. And Hazrat Mahdi (as) appoints various other people as imams, the Prophet Jesus (as) will be his head vizier, he makes him an imam too.
It is a miracle that Prophet Mohammed (pbuh) knew that white minarets would be built in the end times. There weren’t minarets in his time. And he says that it will happen. It is an amazing miracle. So in Istanbul, or in Jerusalem, or in a place like that, the Prophet Jesus (as) will lead the prayer in a mosque with a white minaret, in the area called Sham.
